Last Thursday, we had an unforgettable evening with our valued clients, friends and business partners at our 𝗦𝘂𝗺𝗺𝗲𝗿 𝗖𝗹𝗼𝘀𝗶𝗻𝗴 𝗣𝗮𝗿𝘁𝘆. It was a celebration of our gratitude, wrapped in pure enchantment. In our home, high above the rooftops of Vienna’s historic district, the setting was as special as the occasion. As the evening blossomed, it transformed into more than just a party — it was a journey into a world of wonder. The lively tunes of our favorite jazz band set the tone for a night that sparkled with magic, delightful surprises, and special moments that left us spellbound. This night was our way of saying 𝘵𝘩𝘢𝘯𝘬 𝘺𝘰𝘶 to our guests for their trust and support, and for calling upon us to help in their journey. We are happy to have shared this magical experience with each of you. Here is to more magical moments together, filled with promise, possibility, and shared successes! #SummerClosing #KNOETZL #LeadingtheWayinDisputes

On 23 September marked not only the beginning of the UNCITRAL: United Nations Commission on International Trade Law Working Group III session in Vienna, but also the highly anticipated Institute for Transnational Arbitration ITA Roundtable, hosted by KNOETZL, bringing together practitioners of investment treaty arbitration, arbitrators, States’ representatives and international observers. The panel discussion Denying the Benefits of Investment Treaties: Proposals at UNCITRAL Working Group III, focused on the Draft Provision 17 of the UNCITRAL paper A/CN.9/WG.III/WP.244, acknowledging, thus, not only the critical importance of the ‘denial of benefits’ clause, but also the necessity to thoroughly address its application, in particular in the context of the proposed paragraph 2. The discussion was insightful, engaging and provided valuable takeaways. A big thank you to the esteemed panelists Lorena Fatás Pérez (Ministerio de la Presidencia, Justicia y Relaciones con las Cortes), Professor Dr. August Reinisch (University of Vienna), Tom Sikora (ExxonMobil) and Florian Haugeneder (KNOETZL), under the skilful moderation of Dr Crina Baltag, FCIArb (Stockholm University), who presented diverse views, including those of the States and of the foreign investors, as well as to the participants for their active participation and making the event so impactful. The guests of the event were welcomed by Anna Joubin-Bret (UNCITRAL) and Jurgita Petkutė (KNOETZL). Many thanks to everyone who joined us and we look forward to continuing the dialogue and exploring cooperative solutions, driving the next wave of developments! #UNCITRAL #InvestmentTreaty #ITARoundtable #KNOETZL

The Roundtable will focus on Draft Provision 17 of the UNCITRAL paper A/CN.9/WG.III/WP.244 which addresses the ‘denial of benefits’ clause, allowing States to deny the protection offered to investors or investments that they did not intend to protect. While paragraph 1 of the Draft Provision is based on similar provisions in recent investment treaties, paragraph 2 generously extends the scope of the ‘denial of benefits’ clause to cover situations of third-party funding, unlawful investments, and investments resulting from, or involving, corruption and other illegal actions. The panel of speakers Lorena Fatás Pérez (Ministerio de la Presidencia, Justicia y Relaciones con las Cortes), Professor Dr. August Reinisch (University of Vienna), Tom Sikora (ExxonMobil) and Florian Haugeneder (KNOETZL), under the moderation of Dr Crina Baltag, FCIArb, will present diverse views on the topic, including those of the #States and of the foreign investors. What a fantastic end of the #SummerCelebration! Our #team took a well-deserved break from the office and headed to the beautiful Alte Donau for an unforgettable summer gathering. From competing in some seriously fun pedal boat races to soaking up the sun, it was a perfect way to unwind and reconnect outside the office. The friendly rivalry brought out our best sides, but above all, it was amazing to see everyone come together. Our team spirit was on full display as we navigated the waters together, proving that we’re just as strong and competitive off the clock as we are in the court. It’s moments like these that remind us how important it is to build relationships, strengthen bonds and have a little fun along the way! Thanks to everyone for the positive energy and here is to many more moments of teamwork and fun, both in and out of the office. We are ready to tackle whatever comes next! #KNOETZL #TeamSpirit #SummerRetreat
