Advocating for Mortgage & Finance brokers,: -  who is following the case between LMG and Revenue NSW? - here is an interesting observation of a potential positive side affect - the classification of mortgage brokers as employees under the long-running court case between Loan Market Group Pty Ltd/Loan Market Pty Ltd and Revenue NSW regarding the application of payroll tax to certain brokers; ( should this be substantiated in Revenue NSW’s Favor), this could significantly impact the finance industry with a “side-effect” of providing brokers with more protection against unfair contract terms, particularly clawback clauses. This shift could stimulate broader discussions about contract fairness and potentially lead to reforms that benefit brokers. Brokers may have more grounds to challenge clawback clauses. If brokers are classified as employees, the standard form contracts between banks, aggregators, and brokers may need to be restructured to comply with employment laws and payroll tax obligations. These clauses, which allow banks to reclaim commissions if loans are repaid or refinanced early, could be scrutinized under employee rights frameworks.
