A recent NSW Court of Appeal decision will impact 60 #StateSignificantDevelopment (SSD) projects and threaten 21 which have recently been granted consent. The recent NSW Court of Appeal case has ruled that the likely impacts of all parts of an SSD must be assessed under Part 4 of the EP&A Act, closing off the commonly used Part 5 pathway for enabling infrastructure like road upgrades and transmission connections. In response, the Government introduced a Bill to overcome these issues by providing a process for the Planning Secretary to determine whether an activity is or is not part of a single proposed development, as well as validate past decisions to protect them from legal challenge. The proposed amendments are a welcome response to the Court of Appeal decision and although it will be another step in the assessment process, offer proponents a pathway to certainty on what forms part of the development. The recently released Transport for NSW ‘Guide to Transport Impact Assessment’ is effective from Monday 4 November 2024, replacing the 2002 Guide to Traffic Generating Development. The updated guide includes new recommendations on assessing impacts across multimodal transport networks, site access design, managing travel demand, methods for estimating trip generation, and updated parking guidelines. Our Transport Engineering and Planning team has prepared a summary of some the key changes in the new guide.
