Her Honour Judge Louise Goodchild is a Judge of the Federal Circuit and Family Court of Australia Division 2. Her Honor currently sits in the Family Law jurisdiction in the Brisbane Registry. When first appointed in February 2023 her Honor sat in the General Federal Law division of the Court in Sydney. Judge Goodchild has a Bachelor of Arts and a Bachelor of Laws from University of New South Wales. Prior to her appointment to the bench, her Honor practised as a barrister in Sydney and later in Brisbane having been called to the Bar in 2005. Her Honour’s practice at the bar was varied including native title and defamation law, wills and estate law and family law. Prior to being called to the Bar, Judge Goodchild practised as a solicitor in criminal law and native title law in New South Wales and Queensland. Her Honour’s previous experience also included an appointment as a Senior Judicial Member of the New South Wales Civil and Administrative Tribunal. In 2025, her Honour will replace Judge Josephine Willis as the presiding Judge for the Family Specialist Indigenous List in Queensland. She will share her views on the importance of the Specialist Indigenous lists within the Family courts, reflect on the recent Family Law Reforms and take questions from attendees. What does the Court consider when making a parenting order for your children? When deciding how much time a child should spend with each parent, the court considers the parents’ circumstances and what would be in the child’s best interests. There are six factors the court must consider: 1. What arrangements would promote the physical and psychological safety of the children and each person who cares for the children. (This includes considering any exposure to family violence, abuse, neglect or other harm as well as any family violence orders). 2. The views of the child considering their age and level of maturity. (There is no set age when a child can decide where they will live or how much time they will have with the other parent). The court doesn’t usually hear directly from children and children don’t usually go into court. The child’s views are mostly conveyed through a report or an Independent Children’s Lawyer. 3. The developmental, psychological, emotional and cultural needs of the child as well as any special medical or complex emotional needs of the child. 4. The capacity of each person to provide for the child’s developmental, psychological and emotional and cultural needs such as a parent’s working arrangements, appropriate accommodation and capacity to transport the child. 5. The child being able to have a safe relationship with both parents as well as other people who are significant to the child. 6. Any other factors that are relevant to the circumstances of the child. If a child is Aboriginal or Torres Strait Islander, the court must also consider additional factors such as: ➡️The child’s right to enjoy, understand and appreciate their First Nations’ culture by receiving support, opportunity, development and encouragement; and ➡️Connect with and maintain a connection with family and community members. FAMILY LAW AMENDMENT BILL WEBINAR - RECORDING AND SLIDES NOW AVAILABLE 👇 BACKGROUND: Where the family law reforms of 2023 focused principally on safety and clarity in parenting orders, the key amendments in this bill make resolving property and financial aspects of relationship breakdown safer, simpler and fairer for separating families. The bill implements improvements to the legal frameworks underpinning: ✔Property settlements and spousal maintenance matters, including to specifically recognise the economic impact of family violence on the wealth and welfare of Australian families. ✔Safety measures: including amendments to enhance the operation of Children's Contact Services, clarifying important aspects of family law, safeguarding sensitive information in family law proceedings, including specific factors for decisions about family pets, and supporting the effective operation of the Federal Circuit and Family Court of Australia. ABOUT THE SESSION: The Government introduced the Family Law Amendment Bill 2024 into the Commonwealth Parliament on 22 August 2024. The Bill makes important and significant reforms to Australia’s family law system with a focus on property and financial matters. The Bill also establishes a legislative power for the Government to regulate Children’s Contact Services to support the safe supervision and changeover of children.
