On 11 October 2024, Judge Murdoch gave the keynote address ‘Perspectives from the Bench: Coercive Control in the FCFCOA’, at the 2024 Queensland Law Society Family and Criminal Law Conference. Over 200 solicitors and barristers attended from across Queensland. The conference theme was Family, Criminal and Domestic Violence. Judge Murdoch spoke about how the lens through which a judge views coercive and controlling behaviour and the mandated judicial fact-finding process in the family law jurisdiction is vastly different to that undertaken in criminal matters, even though the behaviours and impact it has on families does not differ. #fcfcoa #familylaw #auslaw #qls

The Federal Circuit and Family Court of Australia was established by the Federal Circuit and Family Court of Australia Act 2021, bringing together the Family Court of Australia and the Federal Circuit Court of Australia. These reforms received Royal Assent on 1 March 2021 and commenced on 1 September 2021. The Court comprises two divisions: • Division 1 (a continuation of the Family Court of Australia) deals with family law matters. • Division 2 (a continuation of the Federal Circuit Court of Australia) deals with family law, migration and general federal law matters. With a focus on innovation and fair and efficient processes that centre on risk, responsiveness and resolution, the new Court provides Australian families the opportunity to resolve their disputes faster through simplified procedures. The system prioritises minimising risk and harm to children and vulnerable parties, and parties are given ongoing opportunities for dispute resolution where it is safe to do so. For those cases that do need to proceed to litigation, the Court provides a modern, transparent and more efficient system of justice which is aimed at getting these parties through the process as safely, quickly and fairly as possible without undue delay. In the general federal law and migration jurisdictions, the Court ensures that justice is delivered effectively and efficiently through the enhanced use of technology and centralised case management processes.

The Chief Justice has issued Family Law Practice Direction – Defaulters’ List. The purpose of the Defaulters’ List is to ensure compliance with the rules of court, and any case management orders and directions made by a Registrar in family law or child support proceedings. The Defaulters’ List is intended to further the overarching purpose of family law practice and procedure. Judge D Humphreys represented the FCFCOA at the 37th LAWASIA (The Law Association for Asia and the Pacific) annual conference in Kuala Lumpur, Malaysia between 13 and 15 October 2024. The theme of the conference was ’Navigating the Legal landscape in the Digital Age’. Judge Humphreys addressed a session entitled “Justice Reimagined: the role of technology in the legal profession and beyond’. Lighthouse is a world-first family violence and safety initiative of the Federal Circuit and Family Court of Australia (FCFCOA). Since 2022 Lighthouse has been expanded to 15 family law registries around Australia. The primary focus of Lighthouse is risk screening for risks including family violence and other safety issues. This allows the Courts to ensure that parties are supported and that court resources are targeted to where they are most needed. As part of Lighthouse, parties first complete the Family DOORS Triage questionnaire, which involves providing only yes/no answers. A specialised team is then able to identify the level of risk and the most appropriate case management pathway. Parties are also provided with information and referrals based on their identified needs and circumstances. Cases that have the highest identified level of risk are placed on the specialised court list - the Evatt List. Other cases are considered for alternative case management pathways, including dispute resolution if appropriate. On Thursday 10 October, the FCFCOA (Division 2) launched its animated migration video series at an event hosted by Judge Kendall in Sydney. The videos form part of the Court’s overarching commitment to improving access to justice for culturally and linguistically diverse people from migrant and refugee backgrounds. The launch of the videos is the culmination of a significant amount of work by judicial officers and staff in collaboration, with the Court’s Director of Media and Public Affairs, Denise Healy playing a pivotal role. Last week, his Honour Judge Kemp participated in the International Bar Association's (IBA) Annual Conference 2024 in Mexico. Judge Kemp spoke in a joint session presented by the Professional Ethics Committee and the Family Law Committee on the topic of shopping for lawyers and the ethical implications this has on the Court system. The IBA's annual conference attracts over 5,000 international legal professionals from over 130 jurisdictions and presents an unmatched networking and learning experience for the Court to be involved in. #fcfcoa #IBAConference
