    Key Insights for Charities on Streamlining Employee Transfers 🔎 What happened? MacKillop took over management of the Waranara School in NSW, previously run by Good Shepherd Australia New Zealand (GSANZ). As part of this transition, eight support staff from Waranara School transferred to MacKillop’s employment. These eight employees (Transferring Employees) were covered by the GSANZ Collective Agreement 2016 (GSANZ Agreement). MacKillop successfully sought a FWC order to have the Educational Services (Schools) General Staff Award 2020 applied to the Transferring Employees instead of the GSANZ Agreement, arguing that applying a single award would prevent inequities and streamline operations. It also promised to provide similar entitlements such that Transferring Employees would not face an overall reduction in pay. The FWC can make an order that an existing industrial instrument (e.g. Modern Award) that applies to an employer also applies to a transferring employee but has to consider various factors before making this decision – e.g. views of the parties, economic disadvantages to the new employer or Transferring Employees, degree of synergy between the transferring instrument and the existing instrument, public interest, etc. 📌 Key Takeaways: The default position is generally that an existing industrial instrument follows the employee where there is a transfer of business, but not always. “There must be a balance struct between the protection of employees’ conditions of employment and the interests employers have in running their enterprises efficiently”. ⚖️ "Minimising any actual or perceived inequity" is crucial in ensuring consistency for employees performing the same roles. Aligning terms and conditions to the same industrial instrument (e.g. Modern Award) avoids confusion and ensures fairness—vital for not-for-profits. 🚀 The ruling emphasised that "removing inefficiencies and the administrative burden associated with applying the terms of two different industrial instruments" allowed MacKillop to focus its resources on core charitable activities. For other charities, simplifying HR processes helps ensure that their resources are being used to further the charity’s objectives. 💰 MacKillop agreed to ensure that Transferring Employees did not receive “a reduction in their overall take-home pay." This level of care provides employees with the satisfaction that they will not lose their entitlements. Charities can follow this example by maintaining or enhancing employee conditions during such transitions to retain trust and engagement. 🤝 By achieving "industrial harmony" and ensuring the transferring employees for the most part had conditions at least as favourable as their previous ones, MacKillop reduced the risk of workplace discontent. It consulted with the affected employees before making the proposed order, which helped ensure smooth transitions. #Notforprofits #EmploymentLaw #EmployeeTransfers Law Squared
