🌟 **Much awaited Judgement re Income Tax Ordinance 1984** 🌟 Our esteemed Head of Chambers, Mr. Tanjib Alam, Barrister and Senior Advocate, alongside our distinguished Partner, Mr. M. Saquib Uzzaman, Barrister and Advocate of the Supreme Court of Bangladesh, have successfully represented Hapag-Lloyd AG, one of the biggest main line operator in arguing that charges such as – demurrage, handling and similar fees constitute taxable income for non-resident principals and hence eligible for international outward remittance after payment of applicable taxes 🎉 This landmark judgment will not only clarify the position regarding “income” and remittance but also encourage and attract foreign direct investment in Bangladesh since this gives clear indication that the Courts will not shy away upholding a foreign investors fundamental right to property who has been guaranteed fair and equitable treatment under section 4 of the Foreign Private Investment (Promotion and Protection) Act, 1980.  🌍⚓️

Recently Tanjib Alam and Associates represented a global brand in door to door food delivery service provider most commonly known as "Foodpanda" . The Bangladesh chapter i.e. Foodpanda Bangladesh Ltd., through the tireless effort of its foreign investors and stake holders have become a household name in internet based food delivery market, rapidly outpacing its competitors in customer acquisition and service delivery. With modern technologies the word "gliches" is synonimous and despite constant innovation and improvements, it occurs randomly and we face it in our day to day life. We successfully represented Foodpanda, in a judicial review petition before the Hon'ble High Court Division where unfortunately we had to challenge an adminstrative decision of a regulatory authority emanating from their quasi judicial powers. The administrative decision was challenged on the ground of being unlawful, unreasonable and disproportionate. After considering the arguments presented by the counsel Mr. M. Saquib Uzzaman, Barrister-at-Law and Advocate of the Supreme Court of Bangladesh representing Foodpanda Bangladesh, the Hon’ble High Court Division found prima facie and arguable case in favour of Foodpanda and passed an interim order staying the operation of the regulator’s decision. 🚢 Celebrating a Landmark Victory in Admiralty Law! ⚖️ We are proud to announce that our partner Mr. M. Saquib Uzzaman, Barrister-at-Law and Advocate of the Supreme Court of Bangladesh has successfully represented the owners and interested parties of the vessel M.V. HANSA Centurion in an Admiralty Suit. He was assisted by our Associate, Mr. Alfaed Salahuddin, Barrister-at-Law. Their efforts led to the return of the plaint in an Admiralty Suit, based on the critical finding that the claim was initiated beyond the statutory limitation period. This case holds significant importance for Admiralty and Maritime practitioners, as it reaffirms that when the Admiralty Court lacks the necessary jurisdiction, the plaint must be returned for presentation to the appropriate court. Moreover, the court reiterated that under Article III Rule 6 of the Schedule to the Carriage of Goods by Sea Act, 1925, the limitation period for claims related to loss and damage is set at one year, after which carriers and vessels are discharged from liability.
