Brazilian and Dutch Lawyer | Braziliaanse advocaat | Simplifying legal matters for foreign companies in Brazil
Yesterday I had the pleasure to participate in a roundtable hosted by the Dutch Consul in São Paulo Kingdom of the Netherlands in Brazil and speak about the impact of the Corporate Sustainability Due Diligence Directive (CSDDD) in Brazil and some other legal aspects: ✔️The importance of clearly delimitating the scope of the obligations under the CSDDD; ✔️The fact that most of these obligations are already aligned with Brazilian legislation - Brazil has ratified the international conventions that the CSDDD refers to - but the main problem is enforcement; ✔️The challenges that Brazilian companies might face to provide information and prove that it complies with obligations under the CSDDD (i.e. how to prove that there is no child labour, will a certification be enough and if so which one, the problems with the proof of right of use of land in Brazil etc). To shed light on the (near) future, I also highlighted the importance of companies and lawyers being aware of contract guarantees and right to recourse clauses, as these could increase liability within the supply chain and also international legal disputes.
