Welcome clarity has been provided on the Government’s proposed implementation of OECD’s GloBE Rules following announcements made earlier this year Yesterday, the Government of The Bahamas released its draft Domestic Minimum Top-Up Tax Bill, 2024 for public consultation. The bill aims to introduce a qualified domestic minimum top-up tax (DMTT) on large multinational enterprises with at least €750 million or equivalent in annual turnover, to come into general effect for fiscal years beginning on or after December 31, 2023. The bill will not apply to constituent entities of foreign multinational groups until fiscal years beginning on or after January 1, 2025, unless such groups are subject to an income inclusion rule or undertaxed profits rule in another jurisdiction. Section 3(1) of the bill immediately clarifies that the introduced DMTT must meet the requirements of the OECD Inclusive Framework. The Bahamas is one of over 130 countries addressing base erosion and profit shifting in a time of increasing globalisation. All in-scope multinational enterprises will be required to pay tax at a minimum effective rate of 15% of profits earned in all participating jurisdictions in which they operate. The Bahamas intends to implement a top-up tax formula for net GloBE income mirroring Chapter 3 of the GloBE Model Rules, while generally disapplying provisions relating to an income inclusion rule or undertaxed profits rule.
