This is a reminder that we issued a province-wide industry notice following the confirmation of cases of removal of “Contract A” from the procurement process by some project owners, in the province. We have seen instances of municipalities and public agencies adopting this language and practice in their procurement process. We note with some alarm that they are beginning to increase in the province, and this is a very concerning trend for our construction members. ACA has continued to advocate for the use of standard contract language, such as CCDC, because it protects both parties fairly and consistently. The attempted removal of “Contract A” is a significant violation of the public sector procurement process and may constitute unacceptable levels of risk for contractors. It is important to note that a procurement document that includes wording attempting to exclude Contract A will not necessarily, in and of itself, waive the common law duty of the owner to act fairly. However, contractors should be aware of this practice and how best to manage through it. Please contact your local construction association or ACA at info@albertaconstruction.net, if you become aware of any irregularities in the procurement process for public owners. Thank you Mark Parsons and your team for this in-depth report. We were pleased to have this discussion at the ACA June Board meeting. Our industry continues to take steps towards Canada's and Alberta's productivity challenge. There is more to be done, though. ACA and our local partners will continue to support our members through access to skilled labour and training, reducing unnecessary red tape and barriers to growth, and supporting the adoption of new technological improvements. And, our advocacy will keep the construction sector's productivity front and centre in discussions with the province. We look forward to continuing this discussion. The Alberta government announced last week that they were suspending the Canada-Alberta Job Grant (CAJG) due to the cut of the Labour Market Transfer Agreement (LMTA). ACA and our Local Construction Associations have reached out to the government to express our concern. The CAJG being on hold comes at a time when Alberta is seeing an increase in demand for construction labour and many people are considering retirements. According to Buildforce, the gap in new entrant’s vs retirements will mean we could have 22,000 vacancies by 2033. The impacts on reducing or withdrawing funding to labour-training programs comes at a time when we need it the most. This funding has been key in developing programs to help our members train skilled workers this cut may unduly hurt construction businesses’ ability to increase their productivity and remain competitive. We would urge that the provincial government work with the federal government to find a solution and return the funding to the Canada-Alberta Job Grant. ALP Program Update: As of last Thursday, August 1st, you are able to select the Alternate Locate Provider Option on new locate request tickets. The Alternate Locate Provider (ALP) Program is a new option for how locates can be delivered in Alberta. The ALP Program provides excavators with the option to hire an approved locator to complete locates on behalf of participating Utility Safety Partner members.
