Whose Duty is it to Repair and Maintain? In the Spring/Summer 2024 Edition of Strata Connection, Phil Dougan, Citadel Law Corporation, explores the evolving question of who is responsible for the repair and maintenance of common property in stratas. Historically, the Strata Property Act placed this duty on the corporation. However, recent interpretations, particularly of Section 72, have opened the door for individual owners to be held responsible for repairs, especially when dealing with limited common property (LCP).
