Whether you're in a common law relationship or married, understanding property ownership, legal agreements, and financial considerations is essential. Here’s what you need to know: 1. Understanding Property Ownership Sole Ownership: If the property is in your name only, it's generally considered yours. But watch out—financial or other contributions from your partner can complicate this. Joint Ownership: If you purchase property together, you'll either be joint tenants (survivor inherits) or tenants in common (shares can be passed to heirs). Know the difference before signing anything. 2. Common Law vs. Marriage In Ontario, common law couples living together for three years, or less with a child, may have property rights similar to married couples. In a marriage, both partners have rights to any property acquired during the relationship, no matter whose name is on the title. 3. Division of Property upon Separation Upon separation or divorce, Ontario follows the principle of equalization of net family property (NFP). If you owned property before the relationship, its value could be excluded from the NFP, unless its value increased significantly due to joint contributions. 4. Estate Planning It’s important to draft a will that reflects your wishes. In the absence of a will, Ontario’s intestacy laws will dictate asset distribution, which may not align with your preferences. Update beneficiary designations regularly and consider a power of attorney for property and personal care. 5. Gifts or inheritances may impact property ownership, so clarify these details early. 6. Legal Agreements Cohabitation Agreements: If you’re in a common law relationship, a cohabitation agreement can define property rights, especially if significant assets are involved. Marriage Contracts: For married couples, a prenuptial or marriage contract can establish property ownership rights and responsibilities in case of separation. 7. Consulting Professionals To protect your interests, it’s best to consult with both a real estate lawyer and a family lawyer to ensure that your legal documents and agreements reflect your wishes. 8. Insurance Finally, protect your property with insurance. Property and liability insurance are vital for securing your assets.
