I am excited to be part of Canada's first Professional L.L.M Program in Construction Law. Tomorrow's class will focus on construction dispute resolution and I will discuss using Adjudication to resolve disputes. With more provinces and the Federal government legislating the availability of Adjudication in the construction industry it is an important and timely topic for many involved in this industry. Are the ODACC Determinations Enforceable?  Yes. Once a Determination is made by the Adjudicator it is binding on the parties to the adjudication until a determination of the matter by a court, a Determination of the matter by way of an arbitration under the Arbitration Act, 1991 or a written agreement between the parties respecting the matter.  Any party to the adjudication may file the Determination with the Court and it is enforceable as if it were an order of the court. When can a Claimant in an ODACC Adjudication expect a decision to be made by the Adjudicator?   The Adjudicator will make a Determination within 30 days from the day the Claimant submits its documents (the “Due Date”). The Due Date may be extended with the consent of all the Parties and the Adjudicator. The next Construction Adjudication and ODACC Orientation Program is September 24 – 25, 2024. This Program is designed for anyone interested in becoming a Certified ODACC Adjudicator for construction contract disputes or for anyone who simply wishes to know more about the adjudication regime under the Ontario Construction Act. The Program is designed to provide participants with: a. An understanding of the adjudication regime; b. An understanding of the role of the adjudicator under the Act; c. Information regarding the adjudication process and fees; d. How be effective as an adjudicator; e. An understanding of an adjudicator’s powers and procedural fairness; f. An understanding of the types of disputes that can be adjudicated; g. An understanding of the Adjudicators’ Code of Conduct; h. Guidance to help adjudicators avoid common mistakes; i. Writing a determination; and j. An introduction to the online custom electronic adjudication system.
