The RIA is pleased to provide an update on Bill C-59. The Competition Bureau has posted more than 200 submissions on its website in response to the consultation regarding the Competition Act’s New Greenwashing Provisions. We are encouraged by the wide array of responses representing many facets of the Canadian economy. A cursory review of some of the responses found common themes which are broadly aligned with the RIA’s submission: - General support for the intentions of the provisions, but significant concerns including the negative impact on climate-related and ESG disclosures, the potential for enforcement action, liability and private right of action - Suggestions for alignment with frameworks such as SBTi and the proposed Canadian Sustainability Standards Board (CSSB) standards - Specific criteria for acceptable standards would be preferred over of a defined list of methodologies - Distinctions were made between environmental claims related to products and services and aspirational long-term targets - Consideration should be given to existing regulatory frameworks. Certain climate-related disclosures that are subject to securities regulation, including those made by publicly traded companies and investment funds, should not apply to the amendments to the Act - The Bureau is encouraged to work with other regulatory bodies - Clarity is sought around safe harbours and due diligence defense The RIA and its members eagerly await guidance from the Bureau stemming from this consultation and stand ready to provide further assistance. I’m thrilled to share that the Government of Canada has just announced a significant step forward in advancing sustainable finance through a plan to deliver a Canadian sustainable finance taxonomy and mandatory climate-related financial disclosures for large, federally incorporated private companies. Today’s announcement is crucial for two reasons: ✔️ Taxonomy: Canada joins over 40 other countries and jurisdictions that have taxonomies in use or under development to channel global investment into climate-related projects. ✔️ Disclosure: Improved disclosure requirements will support transparency and credibility, as well increased interoperability with global markets. Together, these components will create strong foundation for investors, businesses and government, fostering innovation and growth in the transition to net-zero.
