Loris Bertoliatti résume pour la plateforme juridique en ligne iusNet Droit pénal et Procédure pénale de Schulthess Juristische Medien AG, l’arrêt du Tribunal fédéral suisse TF 6B_1033/2023 du 8 juillet 2024 (destiné à la publication). Dans cet arrêt, le Tribunal fédéral souligne qu’à certaines conditions – qui sont précisément décrites par la Haute Cour – la « personne responsable d’une publication » au sein d’un média (donc ni son auteur ou son rédacteur) a le devoir de s’opposer à une publication dans le média concerné si celle-ci constitue une infraction (par exemple une atteinte à l’honneur d’un tiers). Cette personne peut être tenue pénalement responsable sur la base de l’article 322bis et de l’article 28 du Code pénal si l’auteur de la publication ne peut pas être découvert ou qu’il ne peut pas être traduit en Suisse devant un tribunal. Il s’agit d’un arrêt important sous l’angle du droit des médias mettant en lumière l’attention toute particulière dont le responsable rédactionnel d’un média doit faire preuve avant d’autoriser la publication d’un article dans le média concerné et les risques que ce responsable rédactionnel encourt le cas échéant. En l’occurrence, le responsable rédactionnel concerné ne s’était pas opposé à la publication d’un article au contenu diffamatoire rédigé par un auteur non identifié par les autorités pénales et a dès lors été reconnu coupable d’infraction à l’article 322bis CP. En date du 24 novembre 2024, le peuple suisse devra, notamment, se déterminer sur une modification du droit du bail. Cette modification vise à assouplir les conditions devant permettre à un bailleur de résilier un bail lorsqu’il a besoin des locaux loués pour son propre usage (besoins propres du bailleur). Cela étant et indépendamment de cette votation, le Tribunal fédéral suisse TF a récemment rendu un arrêt qui porte précisément sur cette question et que notre Associé Patrick Blaser commente dans Le Journal de l'Immobilier paru ce 30 octobre. Our summer interns and trainee laywers along with Céline Gautier and Clément Bouvier recently had the opportunity to visit the Swiss Supreme Court in Lausanne.   Thanks to a guided tour, they were able to discover the behind-the-scenes workings of this esteemed legal institution, gain a deeper understanding of its pivotal role in the Swiss justice and further enhance their knowledge of the legal system.   We would like to warmly thank the team at the Supreme Court for their hospitality and for making this experience so enriching and memorable.   This visit also marked the end of our summer internship programme and we would like to congratulate our interns for their dedication and valuable contribution during their journey at BOREL & BARBEY. Josef Alkatout was interviewed by the Swiss RTS radio channel on the topic of child abduction during summer school holidays.   He stressed in particular that the kidnapping parents take advantage of the summer by travelling to their home countries with the excuse of taking the child on a holiday. À la une de Le Journal de l'Immobilier, notre Associé Patrick Blaser revient sur un récent arrêt (ATF 4A_75/2022 du 30 juillet 2024) portant sur les travaux de rénovation des immeubles et leur encouragement par le Tribunal fédéral suisse TF. Le Tribunal fédéral vient en effet d’établir une nouvelle jurisprudence en matière de hausse de loyers lorsque celle-ci est liée à d’importants travaux de rénovation effectués par un bailleur dans son immeuble locatif. Il en ressort qu’il est permis au bailleur qui a effectué d’importants travaux de rénovation sur son immeuble d’augmenter les loyers en tenant compte désormais, dans le cadre de son calcul de rendement, d’un taux hypothécaire supérieur de 0,5% à 2% au taux hypothécaire de référence lorsque ce dernier est inférieur ou égal à 2%.
