The EU Accessibility Act #EAA is a new directive aimed at enhancing product and service accessibility for people with disabilities across various sectors. On 26 July 2024, FINMA published additional guidance for projects seeking to issue stablecoins and for banks providing default guarantees for such projects. The FINMA Guidance 06/2024 sets-out minimum requirements for such default guarantees, argues that due to a general prohibition of anonymous transfers the identity of all holders of stablecoins must be verified according to the anti-money laundering act, and reiterates that projects seeking to issue stablecoins must assess whether they require a license under the banking- or the collective investment scheme act. Amongst other reasons, FINMA deems its supervisory practice to be necessary due to international standards set by the Financial Action Task Force (FATF) and the Financial Stability Board (FSB). Die Eidgenössische Finanzmarktaufsicht #FINMA hat eine Anhörung zu einem neuen Rundschreiben über die Verhaltenspflichten gemäss dem Finanzdienstleistungsgesetz #FIDLEG eingeleitet. ➡ Ziel ist es, Klarheit über die Aufsichtspraxis zu schaffen und einheitliche Standards für den Anlegerschutz zu etablieren. Die Anhörung läuft bis zum 15. Juli 2024. Das FIDLEG soll durch das Rundschreiben in seiner Anwendung präzisiert werden, um eine konsistente Umsetzung sicherzustellen.
