But is it actually legally possible to establish a DAO in Switzerland? Here’s the reality: 💡 Legal Uncertainty While Switzerland is very blockchain-friendly, there’s still a gray area when it comes to DAOs that exist purely online. Swiss law doesn’t yet fully recognize these digital-only entities, meaning there are challenges if a DAO isn’t officially incorporated in a physical jurisdiction. 🏛 Classifying DAOs There are two main ideas for how DAOs could fit into Swiss law. Some experts believe DAOs could be treated like traditional companies, such as limited companies (SA). Others think they’re more like a “simple partnership,” where members agree to a set of rules but don’t have a formal legal entity. So, what’s the way forward? A possible approach is treating DAOs like foreign companies under Swiss private law.
