On March 4, Paul Hastings will launch our Fintech Crypto Legal Hackathon, an opportunity for law students to become leaders in proposing legal solutions to regulatory problems in the still-unsettled digital asset space. A U.S. district court has preliminarily enjoined certain aspects of President Trump’s executive order that sought to eliminate affirmative action requirements for federal contractors and root out DEI in the private sector. Affected companies had already been carefully evaluating the executive order’s impact, including in the face of court challenges, and this injunction has further complicated this analysis. Companies that contract with — or receive grants from — the federal government should take particular note of President Trump’s Executive Order 14173 (titled “Ending Illegal Discrimination and Restoring Merit-Based Opportunity”), which targets what it refers to as companies’ “illegal” diversity, equity and inclusion (DEI) policies. Executive Order 14173 seeks to impose new federal-contract requirements that could expose companies to investigations and liability under the False Claims Act on account of their DEI programs.
