The House of Representatives of Cyprus has enacted the Civil Procedure (Amendment) (No. 2) Law of 2024 [Law 147(I)/2024], which was published in the Official Gazette of the Republic on 13 December 2024. This amendment modifies Article 59 of the principal law, introducing a statutory obligation for creditors to notify the District Land Registry of the settlement of a court-registered charge (MEMO) within 30 days. These changes aim to streamline legal procedures and enhance efficiency in real estate transactions. #LawDoneRight

The concept of fundamental dishonesty is a doctrine primarily developed in England and Wales to address fraudulent or exaggerated claims in civil litigation. This doctrine, which allows courts to strike out dishonest claims, has been a subject of interest in common law jurisdictions. A recent judgment in Cyprus, in which our firm represented the defendants in a civil traffic accident case, has acknowledged the applicability of the fundamental dishonesty principle under appropriate circumstances, signalling a potential shift towards stricter judicial scrutiny of dubious claims. #LawDoneRight

A recent court ruling in Cyprus, in which our firm represented the auditors, has dismissed a case alleging auditor negligence, reaffirming the professional standards required for liability in such matters. The plaintiffs sought damages from the defendant auditors, arguing that their failure to act diligently resulted in financial losses. However, the court found no basis for negligence and ruled in favour of the auditors. #LawDoneRight

In the recent decision No. 267/2020 dated 23/1/2025, the Supreme Court addressed the principles governing the rectification of insurance documents, particularly vehicle insurance policies, and the circumstances under which such errors do not constitute mutual mistakes, thereby allowing the insurer to deny coverage. #LawDoneRight #Insurance #Personalinjury
