The Academy of European Law (ERA) is a non-profit public foundation based in Trier, Germany, which is supported by the EU and whose patrons now include all 27 EU Member States as well as Albania, the United Kingdom, the German states, and the City of Trier.     Last week I attended the www.cep-probation.org Expert Workshop on Enhancing the Implementation of Framework Decisions 2008/JHA/947 & 2009/JHA/829 in The Hague (full report of the event can be found here: https://lnkd.in/gPE6Djyv) to present www.era.int new EU co-funded project that will commence from the beginning of next year and last for two years: Detention, Alternatives, Mutual Trust and Mutual Legal Assistance. It will be consist of a blended learning approach of five interactive seminars, which will all include workshops, and five webinars for up to 400 practitioners consisting of judges, prosecutors, lawyers in private practice, prison staff and probation officers. The seminars will look at the following topics in five different host cities: - The European Prison Rules as a standard setter for European prison conditions, relevant ECtHR case law and alternatives to detention, Strasbourg, 2025 - Framework Decisions 829 and 947 and their impact on alternatives to detention, Vilnius, 2025 - The EAW, pre-trial detention, mutual trust and legal assistance and alternatives, Krakow, 2026 - Framework Decision 909 and its impact on the transfer of prisoners, Lisbon, 2026 - Framework Decisions 829 and 947 and their impact on alternatives to detention, Bucharest, 2026   The five webinars will focus on the basic principles of the EAW, the EIO, Framework Decisions 909, 829 and 947.   The workshop provided a great opportunity to meet with probation officers and other practitioners from around the EU, in order to learn from and discuss with them about the challenges they are facing with the use of the two Framework Decisions and also what they have been doing in order to guarantee their better application.   More information about www.era.int upcoming project, including the exact dates of the events, will be made available on its website in due course.

    𝗘𝗥𝗔 𝗶𝗻 𝗠𝗮𝗿𝗯𝗲𝗹𝗹𝗮   🌍 So far in 2024, more than 50 ERA training events have taken place outside Germany, in countries from Portugal to Bulgaria and cities from Athens to Zagreb.   🌴 On 3 and 4 October it was Marbella's turn: Cornelia Riehle, Deputy Head of the Criminal Law Division, hosted an event on 𝗹𝗲𝗴𝗮𝗹 𝗽𝗿𝗼𝗳𝗲𝘀𝘀𝗶𝗼𝗻𝗮𝗹 𝗽𝗿𝗶𝘃𝗶𝗹𝗲𝗴𝗲 𝗶𝗻 𝗰𝗿𝗶𝗺𝗶𝗻𝗮𝗹 𝗽𝗿𝗼𝗰𝗲𝗲𝗱𝗶𝗻𝗴𝘀 𝘁𝗵𝗿𝗼𝘂𝗴𝗵𝗼𝘂𝘁 𝘁𝗵𝗲 𝗘𝗨. This was part of an ongoing project "European Criminal Law for Defence Lawyers", co-funded by the European Commission. Cornelia Riehle says: "Unlike the other events in the series, where we addressed only defence lawyers, in Marbella we brought together lawyers, judges and prosecutors to share their experiences".   📰 The event attracted considerable local attention.     𝗔 𝘄𝗮𝗸𝗲-𝘂𝗽 𝗰𝗮𝗹𝗹 𝗳𝗼𝗿 𝗱𝗲𝗺𝗼𝗰𝗿𝗮𝗰𝘆: 𝗗𝗶𝘀𝗰𝘂𝘀𝘀𝗶𝗼𝗻 𝗽𝗮𝗻𝗲𝗹 𝘄𝗶𝘁𝗵 𝗞𝗮𝘁𝗮𝗿𝗶𝗻𝗮 𝗕𝗮𝗿𝗹𝗲𝘆, 𝗩𝗶𝗰𝗲-𝗣𝗿𝗲𝘀𝗶𝗱𝗲𝗻𝘁 𝗼𝗳 𝘁𝗵𝗲 𝗘𝘂𝗿𝗼𝗽𝗲𝗮𝗻 𝗣𝗮𝗿𝗹𝗶𝗮𝗺𝗲𝗻𝘁   🎤 Last night, the German Chapter welcomed nearly 40 of the Friends of ERA to an online discussion with Katarina Barley, Vice-President of the European Parliament.   From the beginning, the conversation was honest and thought-provoking focusing on the new composition of the European Parliament and the increased influence of the far-right.   Key topics included: 🔹 Democracy in Europe: Concerns about the state of democracy within the EU, with discussions on potential threats to its institutions in the coming years 🔹 The role of fear and the influence of disinformation campaigns within European societies 🔹 The rise of right-wing populism in Germany and the EU overall and how to deal with it 🔹 Migration and asylum policies: Emerging challenges in handling immigration were discussed as well as the EU’s response to both, domestic and external pressures 🔹 EU-UK relations: The possibility of strengthening the relationship with the UK post Brexit with the new British government   As we discussed these complex challenges, our conversation reinforced a clear message: 👥 We remain committed to working together to navigate Europe's future.   Many thanks to our co-chairs, Dr. Julia Laffranque and Prof. Dr.iur.     𝗡𝗲𝘄 𝗘𝗣𝗟𝗖 𝗰𝗹𝗮𝘀𝘀 𝘃𝗶𝘀𝗶𝘁𝘀 𝘁𝗵𝗲 𝗖𝗼𝘂𝗿𝘁 𝗼𝗳 𝗔𝗽𝗽𝗲𝗮𝗹 𝗼𝗳 𝘁𝗵𝗲 𝗨𝗻𝗶𝗳𝗶𝗲𝗱 𝗣𝗮𝘁𝗲𝗻𝘁 𝗖𝗼𝘂𝗿𝘁   🚌 The new EPLC course started with a new item on the agenda: a study visit to the Court of Appeal of the Unified Patent Court in Luxembourg.      🎓 The group of 31 European patent attorneys met at ERA on 25-26 September for their first face-to-face session to mark the start of their EPLC course. They were introduced to the Unified Patent Court (UPC) in the context of the Unitary Patent System, and to the role of the Court of Justice of the European Union (CJEU) and its link to the UPC, before seeing these two institutions in action the following day.     ⚖ At the Der Gerichtshof der Europäischen Union, the group met with Octavia Spineanu-Matei who presented the main aspects of the oral proceeding at the Court. This was followed by a lively discussion, during which she very openly shared her experiences as a former national judge and then as a judge from the General Court and finally as a judge at the Court of Justice of the European Union.    🏛 Together with Judge Ingeborg Simonsson at the Court of Appeal of the UPC, the group had the opportunity to discuss procedural aspects related to the functioning of the Court of Appeal, including issues related to preliminary injunctions, confidentiality clubs, and public access to files.   🤝 For the third year running, ERA is collaborating with Maastricht University to offer the patent litigation course to European patent attorneys. Upon successful completion, participants will receive the European Patent Litigation Certificate. This qualification entitles European patent attorneys to represent parties before the Unified Patent Court. 👥💻 Over a period of nine months, the group will learn about European law, patent law and the UPC Rules of Procedure in face-to-face and online sessions. Mock trial sessions give participants the opportunity to develop their litigation skills, preparing them to represent parties before UPC judges. #patentlaw #upc #patentattorneys #eplc
