Exploring key elements of the U.S. dispute resolution system that European lawyers need to understand. 🇺🇸 🎥 ⬇️ Recently we held one of our BODENHEIMER Itineraries events in Atlanta, Georgia. These are by-invitation-only gatherings of arbitration professionals from different countries at exclusive venues around the world. Each event is unique, in that we invite a prominent speaker who gives a keynote address on a current hot topic in arbitration. This time it was Peter ‘Bo’ Rutledge, Dean of University of Georgia School of Law, who spoke on the key particularities of the U.S. legal system: 🔹 Personal Jurisdiction – European lawyers may not be aware of how U.S. courts handle personal jurisdiction, which can impact the outcomes of disputes significantly. 🔹 Discovery Process – The U.S. discovery process is intricate and plays a crucial role in litigation, something European lawyers might overlook. 🔹 Enforcement of Foreign Judgments and Awards – The U.S. legal system has specific, sometimes arcane, laws governing the enforcement of foreign judgments and arbitral awards, which European professionals should understand.
