🚨 Artists Win Round One in AI Copyright Showdown ... it's just the beginning Defendants:  Stability AI  Midjourney, Inc.,  DeviantArt, Inc.,  Runway AI, Inc. 1️⃣ Copyright infringement claims against AI companies can proceed: - The court allowed direct copyright infringement claims to move forward against Stability AI, Runway AI, Midjourney, and DeviantArt. This suggests artists may have viable claims if their copyrighted works were used to train AI models without permission. 2️⃣ Multiple infringement theories are permissible at this stage: - The court allowed plaintiffs to pursue theories of direct infringement related to both the training process and the operation/outputs of the AI models. This gives artists multiple potential avenues for infringement claims. 3️⃣ Induced infringement claims can proceed: - Claims that AI companies induced copyright infringement by distributing their models were allowed to continue. This could expand potential liability for AI companies. 4️⃣ DMCA claims were dismissed: - The court dismissed claims under the Digital Millennium Copyright Act related to removal of copyright management information. This limits one potential avenue for artists to pursue AI companies. 5️⃣ Lanham Act claims can proceed against Midjourney: - False endorsement and trade dress claims under the Lanham Act were allowed to continue. This suggests artists may have recourse if AI companies use their names or artistic styles in ways that imply endorsement. 6️⃣ Unjust enrichment claims require amendment: - Unjust enrichment claims were dismissed but with leave to amend. Artists may need to carefully craft these claims to avoid preemption by copyright law. 7️⃣ Contract claims against platforms like DeviantArt face challenges: - The court dismissed contract claims against DeviantArt, suggesting artists may face difficulties pursuing platforms that incorporate AI tools under existing terms of service. 8️⃣ The case is proceeding to further stages: - By allowing many claims to continue, the court is permitting this case to move forward to discovery and potentially trial. This will allow for further development of these important legal issues around AI and copyright. Overall, while some claims were dismissed, the court's order generally allows artists to continue pursuing legal action against AI companies for alleged copyright infringement and unauthorized use of their works. However, the specific contours of liability remain to be determined as the case progresses.
