Once upon a time, two public procurement practitioners (Caroline Lehner and myself) pursued the (slightly crazy) idea of publishing an article on a topic we found particularly pressing (and under-researched): In-state procurement (Swiss term), public-public cooperation/non-institutionalized cooperation (EU term). Some years later, our article-idea has indeed become published reality...(who would've thought...)! Please find it in the "European Yearbook of International Economic Law 2023" that was published today (yei)! 📚 Or DM me, if you don't have access. I know, the topic of inhouse/instate-exceptions can become very technical and is not really everyone's favorite topic, however, we believe that it lies at the heart of public (procurement) law and should be discussed more broadly/fundamentally. If you should have any thoughts/critique we are happy to hear them! (Time will tell whether we will start working on a follow-up Article in German at some point... ;))

Are you working on the circular economy and have you always wondered which upcoming EU regulations will be relevant now and in the coming years? Today, at CircuLaw, we have published the most comprehensive, up-to-date, clickable overview (as far as we know it :)), providing insights into this! All relevant pieces of legislation are shown in a clear and logical visual. Each law is assigned to the overarching legal framework (e.g. Fit for 55, Circular Economy Action Plan, etc.), and colours indicate its status: under negotiation, adopted or implemented. CircuLaw closely monitors the status of all the pieces of legislation and keeps these up to date, so that the platform can be used as a 'single source of truth'. Industrial standards are a key feature in our single market . They ensure quality and innovation at the same time. And they give predictability to investors @ “Standort Europe”. I am happy that following the judgment of the Court of 5 March 2024 (C588/P21), the European Commission, CEN-CENELEC and national standardisation bodies are working together on an approach to implement it. In line with the Court ruling, free access to harmonised standards, which are cited in the Official Journal of the European Union, will be provided to all citizens and business. This will be done via readability platforms. We will strive to ensure that - with help of the national standardisation bodies - the first readability platforms will be rolled out across the European Union within the next four weeks. The Commission will be working in close cooperation with the standardisation community to ensure a quick operationalisation of readability platforms. This is a positive development with concrete benefits for citizens, businesses, the European standardisation system and EU overall. It showcases that where there is a will, there’s way. Let’s continue to work in this constructive spirit and bring forward the European standardisation system

The Christmas present just landed! The new Construction Products Regulation is officially published! 👏 4 years of work and dedication from all stakeholders in one document! 😊 A big step forward for our construction industry. Sustainability time is now! 🤩 The Regulation will enter into force 7th January 2025 and it will be applicable as from 8th January 2026.

The CDU/CSU-Bundestagsfraktion proposed repealing the German Supply Chain Act (#LkSG). Similarly, Federal Minister for Economic Affairs, Robert Habeck, made a similar proposal, seemingly without prior coordination with the Green Party. While a suspension of the LkSG seems unlikely, but as far as we understand for the time being not out of the question. Removing reporting requirements seems more likely. Repealing the LkSG would severely impact companies dedicated to human rights and environmental protection. Under the pretext of "bureaucratic overload," there's an attempt to suspend a democratically passed law protecting human rights. This isn't in the "general interest of businesses", as it penalizes the efforts made to implement the law. The so-called "First Movers" – often medium-sized enterprises – are being disadvantaged. The EU #CSDDD is upcoming and requires preparation, and the LkSG serves this purpose for German companies. At atlat, we want to contribute to a #future-oriented and #responsible economy that integrates #sustainability, #humanrights, #transparency, and #profitable business.

The Bundestag yesterday debated a new bill that would implement a two-year pause on Germany’s supply chain law.
