CMS Real Estate hat dies direkt geteilt
On 13 September 2024, the Belgian Supreme Court ruled that a tenant of a hotel is entitled to a rent reduction for the loss of enjoyment resulting from government measures to combat the COVID-19 pandemic. It is the first time the Supreme Court has addressed whether COVID-19 measures can be considered as force majeure for the hotel sector. This landmark decision applied the force majeure doctrine (Article 1722 of the old Civil Code), recognizing that government restrictions, although falling short of a compulsory lockdown, significantly impacted hotel operations and tenant enjoyment.
