BRG professionals recently responded to the UK Competition and Markets Authority's (CMA) consultation on its digital markets competition regime guidance. Read their full response >>> https://lnkd.in/g8_pDvBv Their submission noted that the guidance on strategic market status designation, conduct requirements and pro-competition interventions (PCIs) is drafted very broadly, and sees a risk that this could lead to significant difficulties for the CMA and other stakeholders when it comes to implementing the regime. While one can understand the CMA’s desire to maintain a substantial element of discretion at this stage, that flexibility may provide incentive for many stakeholders to attempt to influence the CMA in how it applies that discretion. As a result, any decisions made by the CMA are likely to be appealed, with the risk that judgments in such appeals will set rule and precedents that the CMA will have to abide by subsequently. This dynamic is likely to obstruct the CMA in its implementation of the regime and lead to delays and costs for all parties, including the CMA. In addition, the timeframe for conducting PCI investigations and imposing remedies appears to be extremely challenging for the CMA to achieve in a robust manner. #CMA #digitalmarkets

In an article in the Financial Times, Colm Gibson comments on Ofwat's recent opening of cases into four more water and wastewater companies, expanding its investigation of sewage outflows to all water and sewage utilities in England and Wales. This will lead to “increased uncertainty for both debt and equity investors [in water companies], with potential implications for the cost of capital Ofwat will need to allow companies to recover in the prices charged to customers,” he says. The principles identified by our survey respondents are natural; AI systems and their outputs are only as good (and safe) as the data they run on. Respondents also identified these three areas as the most important areas for policymakers to address, and the most challenging areas for companies.
