OFAC issued an IFR that would amend its Reporting, Procedures and Penalties Regulations (RPPR) at 31 C.F.R. Part 501, to modify certain reporting requirements pertaining to blocked property and rejected transactions. Subject to any changes OFAC may make following a 30-day comment period, the proposed changes will become effective on August 8, 2024. Notably, the IFR would: ◼️ Narrow the definition of “transactions” for purposes of the rejected transactions reporting requirement under § 501.604(a) such that rejected “sales or purchases of goods or services” must be reported to OFAC, as opposed to all transactions “related to…goods or services.” ◼️ Limit the information that must be reported for such rejected transactions under § 501.604(b) to solely information available to the filer at the time the transaction was rejected. ◼️ Add a requirement to report to OFAC within 10 business days of when any blocked property is unblocked or transferred, including pursuant to a valid order issued by a U.S. government agency or U.S. court. ◼️ Modify and expand the procedure for requests to OFAC to release property blocked due to mistaken identity, typographical or other similar error. Yesterday the EU Parliament released the 'EU Legislation in Progress' briefings updated at key stages throughout the legislative procedure relating to AMLA. Confirmed key takeaways: - In the financial sector, the AMLA is entrusted with direct supervision at group level over certain credit and financial institutions (including crypto-asset service providers (CASP)) that present a high risk and operate in at least six Member States, as selected obliged entities. - The AMLA will also have an indirect supervisory role over non-selected obliged entities in the financial sector through assessments of the state of supervisory convergence, coordination and facilitation of the work of the AML/CFT supervisory colleges. - In the non-financial sector, the AMLA will have oversight through peer reviews, coordination and facilitation of the work of the AML/CFT supervisory colleges. - The authority will support FIUs in the framework of the support and coordination mechanism for FIUs, which is based on a duty of cooperation in good faith and mutual assistance. ❗❗ Communication de l'ESMA sur les Pre-close calls ➡ L'ESMA a publié le 29 mai dernier un « statement » rappelant aux émetteurs le cadre législatif applicable aux « appels de pré-clôture » (ou Pre-close calls) et les encouragent à suivre de bonnes pratiques lorsqu'ils s'engagent dans de ces appels, dans le but de contribuer à maintenir des marchés équitables, ordonnés et efficaces. ➡ Comme le rappelle l’AMAFI, les « Pre-close calls » sont des échanges téléphoniques intervenant entre un émetteur et des analystes pendant la période précédant la publication d’un rapport financier intermédiaire ou de fin d’année. L’ESMA considère que ces échanges comportent des risques de divulgation illicite d’informations privilégiées. ➡ Pour répondre aux préoccupations potentielles liées aux appels de pré-clôture, l’ESMA recommande de suivre plusieurs bonnes pratiques, notamment : -Préalablement à un « pre-close call », procéder à une évaluation de l'information destinée à être divulguée, en s'assurant qu'il ne s'agit pas d'une information privilégiée ; -Informer le public des prochains « pre-clôtures » sur le site Internet de l’émetteur, en soulignant les détails pertinents (date, lieu, sujets et participants) ; -Rendre disponibles simultanément sur le site Internet de l’émetteur le matériel et les documents utilisés. 🥊 L'ESMA note également que l'analyse d'épisodes spécifiques et l'identification de violations potentielles du MAR relèvent des autorités nationales compétentes. 👉🏻 A faire... https://lnkd.in/eAnE3U5q #ESMA #Preclosecalls #KPMGAvocats #KPMGAvocatsFinancialServices

OFAC has published its reporting requirements under the REPO for Ukrainians Act, for all (essentially U.S.) financial institutions at which Russian sovereign assets are located. Any such institutions that “know or should know” of such assets are required to report no later than August 2, 2024 or within 10 days of the detection of such assets, unless already reported pursuant to Directive 4 under E.O. 14024 or in any reports of blocked property to OFAC. Due diligence in identifying all such assets also applies to correspondent or payable-through accounts maintained on behalf of foreign financial institutions. “Financial institution” is broadly defined here, also includes insurance companies. 📢 𝐒𝐰𝐢𝐭𝐳𝐞𝐫𝐥𝐚𝐧𝐝 - 𝐌𝐨𝐧𝐞𝐲 𝐋𝐚𝐮𝐧𝐝𝐞𝐫𝐢𝐧𝐠 𝐑𝐞𝐩𝐨𝐫𝐭𝐢𝐧𝐠 𝐎𝐟𝐟𝐢𝐜𝐞 (𝐌𝐑𝐎𝐒) - 𝐀𝐧𝐧𝐮𝐚𝐥 𝐑𝐞𝐩𝐨𝐫𝐭 𝟐𝟎𝟐𝟑 The Report comments the reasons for the high volume of Suspicious Activity Reports (SARs) over the past decade, which has seen an average annual increase of 20-30%. Key factors include: 📌 The expansion of regulatory due diligence and reporting requirements since 2013. 📌 Increased awareness of the importance of combating money laundering due to numerous scandals in the Swiss banking sector. 📌 Banks have expanded their compliance and financial crime departments. 📌 Technological advancements have improved transaction monitoring capabilities. 📌 The switch from paper-based reporting to the IT application goAML and the XML2 integration in 2020 has simplified the SAR submission process. In 2023, the increase in SARs was steeper than expected, with a total of 11,876 SARs received by MROS, a 56% increase from the previous year. The reporting volume has doubled in the past two years and increased tenfold in the past decade. The potential application of bounties is being positively considered by the Government in Australia after the Senate Inquiry on ASIC recommended incentivising whistle-blowers. 👀 Comment l'administration Erdogan exploite-elle la réglementation de la lutte contre le blanchiment de capitaux et le financement du terrorisme, et manipule-elle les mécanismes de contrôles KYC et CDD? 👉 En nourrissant des informations politiquement partiales et fausses dans les listes de surveillance, le gouvernement oblige les institutions financières à qualifier à tort les dissidents de « à risque », les isolant ainsi des services financiers. 👉 Les processus KYC et CDD impliquant l'utilisation de bases de données publiques, y compris les médias sociaux, le gouvernement turc exploite systématiquement cette vulnérabilité en diffusant de fausses allégations en ligne pour discréditer les dissidents à l'étranger. 👉 L'introduction des systèmes d'IA amplifie considérablement cette répression. Lorsque ces systèmes traitent des données biaisées, ils perpétuent les biais existants, conduisant à une catégorisation inexacte des dissidents en tant que risque élevé, ce qui entraîne des fermetures injustifiées de leurs comptes bancaires et une exclusion financière à plus large échelle. 🏛 Malgré les cadres juridiques existants tels que le RGPD , d'importantes lacunes persistent en matière de conformité réglementaire et de responsabilisation. 🚨 Il est urgent d'ériger des garanties solides et une surveillance accrue au sein des institutions financières afin de protéger l'intégrité de l'utilisation des données personnelles et de défendre les droits des individus contre les abus autoritaires.
