📖 How does #PillarTwo impact local #taxincentive offerings and how do existing, adjusted or new incentives impact the GloBE ETR? 📖 In our previous #KPMG EU Tax Perspectives webcast in December 2024, we had asked the audience whether they are closely monitoring post-Pillar Two tax incentive developments: 💡 41% of the respondents confirmed that they are monitoring new regimes closely 💡Another 41% of the respondents said that they are only starting to consider this for their organization 💡18% of the respondents indicated that they have not considered such developments To shed some more light on the interplay between Pillar Two implementation and local tax incentive offerings, the EU Tax Centre has now published a paper “Pillar Two and Tax Incentives”, which includes considerations on: 📌 how the application of different types of tax incentives may trigger a potential Top-up Tax exposure for MNE Groups 📌how countries may be incentivized to adjust their tax system to ensure effective and efficient tax incentives in a new Pillar Two environment 📌how countries respond to Pillar Two implementation in practice and which actions / legislative amendments have already been taken or are being considered locally Happy reading! There is quite a bit to digest from the package that was released by the #OECD earlier this week, but the new Administrative Guidance on Article 9.1 of the #PillarTwo rules seemed like a good place to start. AG5 sets out additional rules that effectively exclude deferred tax assets from recognition under the transitional rules. The exclusion includes three specific scenarios outlined in the document, in which deferred tax assets are subject to a grace period and limitation. This is meant to address concerns around rules that gave rise to tax benefits resulting in deferred tax assets prior to a CE entering the #GloBE rules.
