𝐎𝐩𝐞𝐧-𝐒𝐨𝐮𝐫𝐜𝐞 𝐂𝐨𝐝𝐞 𝐚𝐧𝐝 𝐀𝐈: 𝐓𝐡𝐞 𝐁𝐚𝐭𝐭𝐥𝐞 𝐟𝐨𝐫 𝐅𝐚𝐢𝐫 𝐔𝐬𝐞 𝐂𝐨𝐧𝐭𝐢𝐧𝐮𝐞𝐬 💻🤖 A recent court ruling dismissed most claims in a lawsuit against GitHub, Microsoft, and OpenAI. This lawsuit was filed by developers in 2022, over GitHub Copilot's unauthorized use of open-source code for AI training. California Judge Jon Tigar dismissed 20 of the 22 claims, finding the AI’s suggested code wasn’t sufficiently similar to the original source. However, the battle is far from over as two critical claims remain: open-source license violation and breach of contract. ⚖️ Open-source code has long been a collaborative cornerstone for developers. However, AI technologies have brought new challenges. The scale at which AI models scrape and use open-source data was unforeseen, leaving many creators vulnerable. Although open-source code might not have the robust access controls protected by the DMCA, the pre-AI era’s measures couldn’t anticipate today’s AI landscape. 🔐 At Fair AI Data we stand with developers, particularly their claims related to unjust enrichment. Companies should not profit at the expense of creators whose work is used without fair compensation. Losing track? We have not stopped counting 📊. 💡Udio and Suno, two promising music generative AI companies, have been sued by a group of major record labels (Sony, Universal, and Warner Records) accusing them of copyright infringement. This is another instance of the ongoing battle between creators and AI companies that are using copyrighted creative work outcomes for commercial purposes. Don’t get us wrong, we are proponents of AI. We think that it is a tool with vast applications that, if used right (debatable interpretation of the word), can provide benefits to humanity. We acknowledge that in creativity there is no parthenogenesis. However, there is a major difference between how a human can be inspired by another’s work versus how a computer learns to identify patterns and produces derivatives of a large magnitude of creative thought processes. 💭 Data is the building block of AI. Without it, companies would not have been able to accumulate such amounts of wealth in such a short term. The problem is that it is YOUR data, not theirs. They didn’t ask; they just took. Aleksandar Prokopec has created a GitHub repository that modifies popular open-source licenses (Apache 2.0, MIT, BSD, etc.) to explicitly prohibit the use of your code in AI training datasets. 💡 These modified licenses can provide a way to secure your work and ensure your code is only used ethically. Also, most of these licenses are permissive to be modified by default.
