Last week our Ming Chak Raphael Wong talked to Hong Kong Economic Times about testamentary freedom in Hong Kong and the risks of claims brought by financial dependants. The common law system gives individuals a great deal of freedom to plan for the distribution of their estate after death, but this freedom is not limitless, especially when the estate involves the interests of financial dependants. More often than not these may not be direct heirs, but their lives rely on the financial support of the deceased. How to strike a balance between testamentary freedom and the rights of dependents is an extremely important issue when planning for your estate or when you have been depending on someone financially then getting excluded from the estate upon his/her death.
