Approval of ‘Town Planning Officer’ addition to the Critical Skills Occupations List The inclusion of town planners on the Critical Skills Occupations List means that eligible non-EEA professionals from outside of Europe will now benefit from streamlined employment permit processes, making it easier for Irish employers to recruit and retain international talent in this vital sector. Minister of State for Planning and Local Government, John Cummins TD said; “The planning system underpins the delivery of many public policy, societal, economic and environmental objectives in Ireland…with the implementation of our new Planning Act now underway, it is crucial that we have the right people and resources in place to ensure we maximise the benefits of the new legislation… “By adding this key profession to the Critical Skills Occupations List, we are taking a decisive step to address planning resource shortages and reinforce the capacity of our planning system to meet current and future needs.” More here: https://bit.ly/41U9ymc

Tom Phillips + Associates were delighted to assist Beauparc Utilities in obtaining a grant of permission from An Bord Pleanála to redevelop the existing Waste Recovery Facility on Ballymount Rd, Ballymout. The Strategic Infrastructure Development (SID) will result in the demolition of all structures on site and the delivery of a modernised waste processing facility, an increased processing capacity from 150k to 350k tonnes, extensive Solar PV, landscaping, car parking and all required infrastructure. The new facility will be vital in managing waste from the Dublin area and maximising the reuse and recycling of waste material. Planning and Development Act 2024 - Implementation Plan Yesterday the Department of Housing, Local Government and Heritage published the Implementation Plan for the Planning and Development Act (2024) with the crux of the Plan outlining how the Act of 2024 will be commenced on a phased basis, with key implementation dates and particulars of the Act as follows: - Block A1 + A2 - It is anticipated that Block A1 will commence in early Q2 2025 with A2 to follow. • Establishment of An Coimisiún Pleanála (i.e. The new An Bord Pleanála) (Part 17). • Appeal Procedures - introduction of mandatory timelines (Part 12). • Revised judicial review provisions (Part 9). • Provisions Relating to Planning Bodies - Ministerial oversight (Part 19). • Repeal of corresponding provisions in the Act of 2000 (Part 1). - Block B1+B2 - It is anticipated that Block B will commence in mid-2025. • Introduction of new strategic policy - National Planning Statements, Urban Area Plans, Priority Area Plans and Coordinated Area Plans (Part 3). • Office of Planning Regulator - Review of Performance of Functions (Part 18). • UDZ - Establishment of Urban Development Zones provisions (Part 22). - Block C+D - Following the commencement of Blocks A and B, it is proposed to commence the remaining provisions of the Act of 2024. No timeframe is provided. Block C+D includes: • Strategic Development Zones (Part 21). • Planning Applications Directly to the Commission (Strategic infrastructure development, Electricity transmission infrastructure development, Strategic gas infrastructure development & Chapter 4 (Maritime, State & Local Authority Development). - New Exempted Development and Environmental Impact Regulations The provisional timeline for preparation of these subject regulations is as follows: • Issues paper Q1 2025. • Consultations Q2 2025. • Finalise Drafting Q2/3 2025. • Oireachtas Approval – Q3 2025 (exempted development regulations only). - New Planning and Development Regulations A Revised Planning and Development Regulations will be finalised to align with the commencement of the relevant provisions in the Act of 2024 which they support. It should be noted that the existing provisions in the Act of 2000 will remain in place until the relevant provisions in the Act of 2024 are commenced and the corresponding provisions in the Act of 2000 are repealed. The Implementation Plan builds in a high degree of flexibility in terms of timeline, with much of the heavy lifting to take place towards the end of 2025 (and likely into 2026).
