On January 3, 2025, the Indian Ministry of Electronics and Information Technology ("MeitY") released the draft Digital Personal Data Protection Rules, 2025 ("Draft Rules") under the Digital Personal Data Protection Act, 2023 (“Act”). As part of the pre-legislative consultation process, the MeitY had invited comments on the Draft Rules from stakeholders. BTG Advaya has submitted its comments on the Draft Rules. The comments suggest modifying the Draft Rules with a view to balance privacy rights vis-à-vis implementation feasibility. The Indian government’s recent advisory directing social media and streaming platforms to remove content deemed obscene or vulgar has raised concerns about broader content regulation. Celebrity children and relatives frequently face false, defamatory, or misleading information published about them, which can cause serious harm to their reputation, mental health, and personal privacy. The Information Technology Act, 2000, empowers authorities to block access to such harmful content, while the Intermediary Guidelines and Digital Media Ethics Code (2021) require social media platforms to remove defamatory or misleading content within a specified timeframe. In a significant relief for private companies, the Ministry of Corporate Affairs vide its notification dated February 12, 2025, has extended the deadline for mandatory dematerialization (Demat) of securities from September 30, 2024, to June 30, 2025. As a result, it is now possible to issue or transfer securities of private limited companies in physical form up to June 30, 2025, instead of the earlier deadline of September 30, 2024.
