The session delved into the essentials of the DPDP law, focusing on its application to the banking and Fintech sector and discussing information security requirements and sectoral standards in depth. Key highlights included discussions on the ambiguity around publishing personal data on public platforms and the crucial importance of understanding one's role under data protection law, especially concerning the handling and processing of personal data. Examples from NBFCs were used to showcase the roles of data fiduciaries and processors, emphasizing the significance of contractual clauses in agreements to ensure data privacy and security between lenders and LSPs. Furthermore, the workshop shed light on the necessity of robust information security systems in the financial services sector, emphasizing the RBI's role in setting guidelines and the importance of due diligence when outsourcing services. Attendees were educated on the critical need for solid contracts with third-party vendors, audit mechanisms, and ample resources to guarantee compliance with regulatory requirements. The session wrapped up with insightful Q&A session moderated by our founder Biplab SenGupta with focus on whys and hows of maintaining entity-level segregation between regulated and unregulated businesses, obtaining customer consent for data use, and the importance of clear data segregation and defined purposes.
