Hindu joint families were the norm, and property was traditionally passed down through the male line. 𝐓𝐡𝐢𝐬 𝐚𝐠𝐞-𝐨𝐥𝐝 𝐩𝐫𝐚𝐜𝐭𝐢𝐜𝐞 𝐛𝐞𝐠𝐚𝐧 𝐭𝐨 𝐜𝐡𝐚𝐧𝐠𝐞 𝐢𝐧 𝟐𝟎𝟎𝟓 when the Hindu Succession Act was amended to grant daughters equal rights to coparcenary property as their brothers. This amendment marked a significant step toward gender equality, promising a future where daughters would no longer be treated as outsiders in their own homes. 𝐇𝐨𝐰𝐞𝐯𝐞𝐫, 𝐭𝐡𝐞 𝐪𝐮𝐞𝐬𝐭𝐢𝐨𝐧 𝐨𝐟 𝐰𝐡𝐞𝐭𝐡𝐞𝐫 𝐭𝐡𝐢𝐬 𝐧𝐞𝐰 𝐥𝐚𝐰 𝐚𝐩𝐩𝐥𝐢𝐞𝐝 𝐫𝐞𝐭𝐫𝐨𝐚𝐜𝐭𝐢𝐯𝐞𝐥𝐲 𝐭𝐨 𝐝𝐚𝐮𝐠𝐡𝐭𝐞𝐫𝐬 𝐰𝐡𝐨𝐬𝐞 𝐟𝐚𝐭𝐡𝐞𝐫𝐬 𝐡𝐚𝐝 𝐚𝐥𝐫𝐞𝐚𝐝𝐲 𝐩𝐚𝐬𝐬𝐞𝐝 𝐚𝐰𝐚𝐲 𝐫𝐞𝐦𝐚𝐢𝐧𝐞𝐝 𝐮𝐧𝐚𝐧𝐬𝐰𝐞𝐫𝐞𝐝. The legal arena was clouded by conflicting interpretations. Some courts argued that the law only applied to daughters whose fathers were alive when the amendment was enacted, while others declared that all daughters, regardless of their father's life or death, were entitled to equal inheritance. Vineeta Sharma found herself at the heart of this legal battle. Her father had passed away before the landmark amendment, and she was denied her rightful share of the family property. 𝐃𝐞𝐭𝐞𝐫𝐦𝐢𝐧𝐞𝐝 𝐭𝐨 𝐜𝐡𝐚𝐥𝐥𝐞𝐧𝐠𝐞 𝐭𝐡𝐞 𝐝𝐢𝐬𝐜𝐫𝐢𝐦𝐢𝐧𝐚𝐭𝐨𝐫𝐲 𝐩𝐫𝐚𝐜𝐭𝐢𝐜𝐞, she took her case to the Supreme Court. She argued that times had changed, that laws had evolved, and that daughters were equal to sons. Her case became a landmark, a courtroom drama where 𝐚𝐠𝐞-𝐨𝐥𝐝 𝐭𝐫𝐚𝐝𝐢𝐭𝐢𝐨𝐧𝐬 𝐜𝐥𝐚𝐬𝐡𝐞𝐝 𝐰𝐢𝐭𝐡 𝐦𝐨𝐝𝐞𝐫𝐧-𝐝𝐚𝐲 𝐞𝐪𝐮𝐚𝐥𝐢𝐭𝐲. 𝐈𝐧 𝐚 𝐡𝐢𝐬𝐭𝐨𝐫𝐢𝐜 𝐝𝐞𝐜𝐢𝐬𝐢𝐨𝐧, the Supreme Court judges ruled in favor of Vineeta. They declared that the law was to be applied retrospectively, meaning it would apply to all daughters, regardless of when they were born. This was a turning point, 𝐚 𝐫𝐞𝐜𝐨𝐠𝐧𝐢𝐭𝐢𝐨𝐧 𝐭𝐡𝐚𝐭 𝐰𝐨𝐦𝐞𝐧 𝐰𝐞𝐫𝐞 𝐞𝐪𝐮𝐚𝐥 𝐢𝐧𝐡𝐞𝐫𝐢𝐭𝐨𝐫𝐬 𝐨𝐟 𝐭𝐡𝐞𝐢𝐫 𝐟𝐚𝐦𝐢𝐥𝐲'𝐬 𝐥𝐞𝐠𝐚𝐜𝐲. 𝐓𝐡𝐢𝐬 𝐜𝐚𝐬𝐞 𝐫𝐞𝐬𝐡𝐚𝐩𝐞𝐝 𝐭𝐡𝐞 𝐥𝐚𝐧𝐝𝐬𝐜𝐚𝐩𝐞 𝐨𝐟 𝐩𝐫𝐨𝐩𝐞𝐫𝐭𝐲 𝐫𝐢𝐠𝐡𝐭𝐬 𝐢𝐧 𝐈𝐧𝐝𝐢𝐚, 𝐝𝐞𝐦𝐨𝐧𝐬𝐭𝐫𝐚𝐭𝐢𝐧𝐠 𝐨𝐧𝐜𝐞 𝐚𝐠𝐚𝐢𝐧 𝐭𝐡𝐚𝐭 𝐭𝐡𝐞 𝐣𝐮𝐝𝐢𝐜𝐢𝐚𝐫𝐲 𝐜𝐚𝐧 𝐚𝐜𝐭 𝐚𝐬 𝐚 𝐜𝐚𝐭𝐚𝐥𝐲𝐬𝐭 𝐟𝐨𝐫 𝐬𝐨𝐜𝐢𝐚𝐥 𝐜𝐡𝐚𝐧𝐠𝐞. By choosing to interpret the law in line with contemporary values of equality, the Indian judiciary reinforced the principle that 𝐣𝐮𝐬𝐭𝐢𝐜𝐞 𝐦𝐮𝐬𝐭 𝐞𝐯𝐨𝐥𝐯𝐞 𝐰𝐢𝐭𝐡 𝐭𝐡𝐞 𝐭𝐢𝐦𝐞𝐬. #landmark

    We're elated to share that our learner & military veteran Rear Admiral Sanjay Roye AVSM VSM was recently felicitated by Hon'ble President of India Smt. Draupadi Murmu at the Presidential Awards Ceremony, where he was presented with the 'Ati Vishisht Seva' Medal. Rear Admiral Roye, a learner from our Independent Director course previously cracked the IICA Independent Directors' Exam and now serves as a board member at Veblen Board Advisory Committee. He is awaiting the announcement of his first Board of Directors position shortly (by the company). Seeing our learners achieve more and be more every day inspires us to be more and do more too. #presidentialaward

    𝐈𝐧 𝐭𝐡𝐞 𝐞𝐚𝐫𝐥𝐲 𝟏𝟗𝟗𝟎𝐬, India was on the cusp of an economic boom. Yet, for many young Indians, 𝐝𝐫𝐞𝐚𝐦 𝐨𝐟 𝐡𝐢𝐠𝐡𝐞𝐫 𝐞𝐝𝐮𝐜𝐚𝐭𝐢𝐨𝐧 remained elusive. Mohini Jain, a Meerut resident, aspired to become a doctor. She applied to an MBBS course in a private medical college in Karnataka. The college management asked her to deposit a sum of Rs. 60,000/- as the tuition fee for the first year and also to show a bank guarantee of the amount equal to the fee for the remaining years. On her father’s intimation that the asked amount was beyond his reach, 𝐦𝐚𝐧𝐚𝐠𝐞𝐦𝐞𝐧𝐭 𝐝𝐞𝐧𝐢𝐞𝐝 𝐌𝐨𝐡𝐢𝐧𝐢’𝐬 𝐚𝐝𝐦𝐢𝐬𝐬𝐢𝐨𝐧 This fee was fixed in lieu of a 1989 Govt. of Karnataka notification which stipulated an annual tuition fee of Rs. 2,000 for students getting "Government seats". However, for students who didn't get these seats, the additional fee, termed as ‘capitation fee’ could skyrocket to Rs. 60,000 per year. Mohini filed a petition, challenging the same, arguing that demanding such exorbitant fees was not just unfair, but a violation of a fundamental right - the right to education. The respondents claimed higher tuition fees were justified for students who didn’t qualify for "Government seats" based on merit. They argued this classification was necessary to cover educational expenses.  The Karnataka Private Medical Colleges Association jumped in, explaining that private colleges received no government support and spent around Rs. 5 lakhs per student for the 5-year MBBS course. With 40% of seats being "Government seats" at Rs. 2,000 annually, the financial burden shifted to the remaining management quota students. At the heart of the case was the constitutionality of capitation fees. Jain's arguments revolved around the violation of equality (𝐀𝐫𝐭𝐢𝐜𝐥𝐞 𝟏𝟒) and the inconsistency with 𝐃𝐢𝐫𝐞𝐜𝐭𝐢𝐯𝐞 𝐏𝐫𝐢𝐧𝐜𝐢𝐩𝐥𝐞𝐬 𝐨𝐟 𝐒𝐭𝐚𝐭𝐞 𝐏𝐨𝐥𝐢𝐜𝐲, which aimed to ensure equal opportunities for all citizens. The state countered, defending the necessity of higher fees to maintain educational standards and sustain private institutions without government aid. In 1992, the Supreme Court ruled in favor of Mohini Jain. The judgment was a turning point, emphasizing that education is fundamental to human dignity and the right to life under 𝐀𝐫𝐭𝐢𝐜𝐥𝐞 𝟐𝟏. Declaring capitation fees unconstitutional, the Court marked a shift from seeing Directive Principles as symbolic ideals to recognizing them as enforceable rights.  This decision laid the groundwork for the 𝟖𝟔𝐭𝐡 𝐂𝐨𝐧𝐬𝐭𝐢𝐭𝐮𝐭𝐢𝐨𝐧𝐚𝐥 𝐀𝐦𝐞𝐧𝐝𝐦𝐞𝐧𝐭 𝐢𝐧 𝟐𝟎𝟎𝟐, which recognized the Right to Education as a fundamental right. The judgment marked a shift in India's understanding of education, elevating it from a privilege to a fundamental right. It was a step towards a 𝐦𝐨𝐫𝐞 𝐞𝐪𝐮𝐢𝐭𝐚𝐛𝐥𝐞 𝐬𝐨𝐜𝐢𝐞𝐭𝐲, where opportunities are not determined by the depth of one's pockets but by the strength of one's character and intellect. #landmark #judgment
