#GST on Commercial #Rent: Understanding Reverse Charge Mechanism (RCM) The Goods and Services Tax (GST) Council at its 54th meeting in New Delhi on September 9 decided to bring the renting of commercial property by an unregistered person to a registered person under Reverse Charge Mechanism (RCM). The Reverse Charge Mechanism (#RCM) under GST plays a significant role in determining tax liabilities in commercial rent agreements, depending on whether the tenant and owner are registered under GST. Here's an overview of how it works: Both Tenant and Owner Unregistered: When neither the tenant nor the owner is registered under GST, no GST is levied. This means there is no GST liability, whether through the Forward Charge Mechanism (FCM) or the Reverse Charge Mechanism (RCM). Unregistered Tenant, Registered Owner: In a scenario where the tenant is unregistered but the owner is registered, GST becomes applicable under FCM. The registered owner is responsible for collecting and paying GST, in accordance with Section 9(1) of the CGST Act, 2017. Both Tenant and Owner Registered: If both the tenant and the owner are registered under GST, the owner collects GST under FCM and remits it to the government. This follows the guidelines of Section 9(1) of the CGST Act, 2017. Registered Tenant, Unregistered Owner: When the tenant is registered and the owner is unregistered, RCM is triggered under Section 9(3) of the CGST Act. In this case, the registered tenant is responsible for paying GST directly, as the unregistered owner cannot collect GST. Registered Composition Tenant: If the tenant is registered under the composition scheme, RCM still applies. However, under Section 10 of the CGST Act, the tenant is not allowed to claim Input Tax Credit (ITC), resulting in a higher cost burden for the tenant. Registered Regular Tenant: In the case of a registered regular tenant, RCM applies, requiring the tenant to pay GST. However, the tenant can claim ITC on the amount paid, as per Section 16 of the CGST Act. This helps reduce the net tax impact. RCM Payment Rules Under GST law, any liabilities arising under RCM must be settled in cash. ITC cannot be used to offset these payments, adding financial consideration for the registered parties involved.
