In the case Bentley Systems Inc. & Anr. vs Pushparaj Kandaswamy & Anr., the Delhi High Court addressed the copyright infringement involving the unauthorised use of Bentley Systems’ proprietary software, ‘MicroStation’. Bentley Systems filed a suit resulting in an ad-interim injunction and appointment of a Local Commissioner and later entered into a settlement agreement, which was rejected by the District Judge. Later, the High Court overturned the decision, recognising the settlement as voluntary and lawful. The Court decreed in favour of the petitioners, incorporating the settlement terms and resolving the dispute amicably. Authors Manisha Singh and Manya Jain analyse the case and discuss the challenges software developers face in protecting intellectual property rights in the digital age.
