On October 22, SEBI directed regulated entities, including recognized stock exchanges, clearing corporations, and depositories, to end any existing contracts with unregistered financial advisors within three months to safeguard investors and uphold market integrity. In an article published by Mint, I share my perspective that the October 22 circular serves primarily as a clarification, as SEBI's June 27 decision was intentionally broad and ambiguous. The aim is to prevent financial influencers from maintaining any financial association with a regulated entity unless explicitly permitted by SEBI. With the Maharashtra Stamp (Amendment) Ordinance, 2024, the powers that be seem to have induced an interesting twist on arbitration proceedings in Maharashtra. Given that an arbitral award is usually stamped before it is issued to the parties, linking the stamp duty to a percentage of the award does seem to be a bit of a naughty step. One thinks that this may lead to enforcement and execution issues as well as instances where arbitrators may not issue awards due to lack of adequate stamp duty being paid. The Bombay High Court, in the case of Bima Nagar Co-operative Housing Society Limited (“the Society”) vs. The Divisional Joint Registrar Co-operative Societies and others provided clarification regarding the definition of a "family arrangement" under Section 154B-13 of the Maharashtra Co-operative Societies Act, 1960 (“Act”). This clarification holds significance in determining if a Succession Certificate is necessary for the transfer of property forming part of the estate of the deceased when a “family arrangement” exists between the legal heirs. The Court dismissed the Society’s petition and affirmed the rulings made by the lower authorities.
