Interestingly, the court dismissed the concerns raised about the valuation of the Fortis trademark and found no merit in delaying the auction for an elaborate valuation exercise. The court opined the auction process itself is expected to discover the optimum price!

The Madras High Court recently resolved a trademark dispute over the ‘STAR’ mark, ruling in favor of Star Plastics. The petitioner, using ‘STAR’ since 1983, argued that Respondent’s similar mark in Class 11 was likely to cause confusion. Despite claims that ‘STAR’ is a common term, the Court upheld the Petitioner’s distinctiveness in the ‘STAR’ mark due to its long-established use and ordered the cancellation of the Respondent’s registration. Court upholds validity of Lock-in period in an Employment agreement Ranjan Narula, summarises a recent interesting case concerning arbitrability of employment contracts and validity of lock-in period clause in such agreements. The lock-in period is closely connected with the risk of IP rights and confidential information exposure. The court in this case determined that the lock-in period does not violate any fundamental rights of the employees. In a recent decision, the Madras High Court upheld the order of the Regional Director directing KCP Infra Ltd. to change its name. The Regional Director had allowed the petition filed by KCP Ltd. under Section 16 of the Companies Act, 2013. KCP Ltd., established in 1941, argued that KCP Infra’s use of “KCP” diluted its brand and caused public confusion, given their longstanding trademark rights. In a recent ruling, the Madras High Court upheld the rights of Lego Juris, a global leader in the toy industry, in a dispute against a confectionery producer over the marks “LEGO CUTEHEART” and “LEGO COFFYBOND.” The Court ruled that despite the difference in product categories (toys vs. confectionery), Lego’s well-known trademark status provides broader protection across classes. The court found the confectionery producer’s use of the LEGO name is likely to cause confusion among children, the shared target audience for both brands. The Division Bench (DB) of the Delhi High Court, in an appeal against the Commercial Court, ruled that the use of the sky-blue background and white font does not merit trademark protection as blue is commonly associated with water. The DB set aside the injunction order passed by the Single Judge, finding that Defendant’s label was not deceptively similar to the Plaintiff’s stressing the importance of evaluating marks as a whole rather than isolated elements.
