About us
Sarin & Co. is one of India’s oldest and leading law firms specializing in Indian and International Law. Originally established by Late Mr. Harbans Lal Sarin in Lahore (now in Pakistan) in the year 1932, the firm shifted to Shimla after the partition of undivided India. Sarin & Co. finally moved to Chandigarh, India when the city was inaugurated as the symbol of a new India in the early 1950s. The firm has a branch office in New Delhi as well. The Firm's expertise includes advising foreign clients, litigation and performs the groundwork for international companies looking to set up their business in India. Sarin & Co. branched out into the field of aviation with the joining of Mr Nitin Sarin in 2008. It is the only law firm in India to provide complete aviation law services to banks, aircraft lessors, financial institutions, international airlines and Governments. Since then, the aviation team (consisting of six lawyers and a head of operations) have handled over USD$ 16 billion worth of transactions and have also carried out some of the most complex aircraft repossessions in the country. The Firm has also advised several international airlines in challenging market access transactions. In 2019, the firm successfully paved the way for the first and only deregistration and export of an aircraft under India’s new Cape Town Convention and Aircraft Protocol Regulations. Sarin & Co's noteworthy clients include the world’s top aircraft manufacturers, leasing companies, international airlines and banks. Sarin Memorial Legal Aid Foundation, the legal aid arm of Sarin & Co., partners with the International Institute of Air and Space Law of Leiden University in the Netherlands to organise the Leiden Sarin International Air Law Moot Court Competition in Chandigarh. Mr. Nitin Sarin is a dual qualified Advocate in India and Solicitor in England and Wales. He is also a guest lecturer at the IIASL, Leiden University as well as a qualified IATA trainer.

Aviation security is a critical aspect of the industry, and one of India's key legal frameworks addressing unlawful acts against civil aviation is The Suppression of Unlawful Acts Against Safety of Civil Aviation Act, 1982 (as amended from time to time). This Act was enacted to prevent and penalize offenses that threaten the safety of aircraft, passengers, and aviation infrastructure. It aligns with India's international obligations under conventions such as the Montreal Convention (1971) and covers: 1. Unlawful acts of violence against passengers or crew onboard an aircraft, sabotage, and attacks on airports & aircraft. 2. Jurisdiction over offenses committed on Indian aircraft, even outside India. 3. Strict penalties, including life imprisonment and death sentences in severe cases. 4. Extradition provisions for offenders, reinforcing global aviation security efforts. With evolving threats to civil aviation, stringent enforcement of this Act remains crucial in safeguarding air travel. #sarinlaw #avgeek

On February 26, 2025, the International Financial Services Centres Authority has issued a circular (“Circular”) whereby the ‘Framework for Aircraft Lease’ (“AL Framework”) (IFSCA circular dated May 18, 2022, as amended) stands further amended. The Circular has amended Clause O.2 of the AL Framework which deals with transactions with person(s) resident in India. According to the Circular, a restriction is imposed on a lessor with respect to purchase, lease or acquisition of any asset (covered under the AL Framework), where post-acquisition, the asset will be operated or used solely by person(s) resident in India or to provide services to person(s) resident in India. However, the aforementioned restriction shall not apply to transactions where (i) lessor acquires the asset from a non-group entity of the lessor; or (ii) lessor acquires the asset as a part of a sale and lease back arrangement where the asset is being imported into India for the first time; or (iii) lessor acquires the asset from a manufacturer of such asset in India.
