𝐃𝐞𝐥𝐡𝐢 𝐇𝐢𝐠𝐡 𝐂𝐨𝐮𝐫𝐭 𝐟𝐨𝐫𝐭𝐢𝐟𝐢𝐞𝐬 𝐭𝐡𝐞 𝐥𝐚𝐰 𝐨𝐧 𝐑𝐞𝐠𝐮𝐥𝐚𝐫𝐢𝐬𝐚𝐭𝐢𝐨𝐧 𝐚𝐧𝐝 𝐑𝐞𝐢𝐧𝐬𝐭𝐚𝐭𝐞𝐦𝐞𝐧𝐭 𝐨𝐟 𝐰𝐨𝐫𝐤𝐞𝐫 (𝐨𝐟 𝐭𝐞𝐦𝐩𝐨𝐫𝐚𝐫𝐲 𝐚𝐧𝐝 𝐜𝐚𝐬𝐮𝐚𝐥 𝐧𝐚𝐭𝐮𝐫𝐞) 𝐢𝐧 𝐦𝐚𝐭𝐭𝐞𝐫𝐬 𝐨𝐟 𝐩𝐮𝐛𝐥𝐢𝐜 𝐞𝐦𝐩𝐥𝐨𝐲𝐦𝐞𝐧𝐭/𝐩𝐮𝐛𝐥𝐢𝐜 𝐩𝐨𝐬𝐭. We are glad that our Associate, Swarnil Dey argued for the successful Petitioner (Punjab National Bank) in Punjab National Bank v. Manoj Kumar [W.P. (C) 4770/2007 and W.P. (C) 5770/2007] The cases pertained to dual questions of right of regularisation and reinstatement of a worker with back wages to a public post, both of which questions were decided in favour of the Bank. In a detailed judgment, the Hon'ble Delhi High Court upheld that there exists no right of regularisation and/or reinstatement of a temporary/casual worker to a public post. Regularising such back-door entry would be antithesis to the principles of public employment under Article 16 of the Constitution of India and also violate Article 14. 𝐑𝐞: 𝐍𝐨 𝐀𝐮𝐭𝐨𝐦𝐚𝐭𝐢𝐜 𝐑𝐞𝐢𝐧𝐬𝐭𝐚𝐭𝐞𝐦𝐞𝐧𝐭 𝐰𝐢𝐭𝐡 𝐁𝐚𝐜𝐤 𝐖𝐚𝐠𝐞𝐬 Reinstatement with back wages is not automatic in every case for a temporary/casual/ad-hoc/contractual worker, when there is violation of Section 25-F of the ID Act. Following the Supreme Court's landmark judgment in Jagbir Singh v. Haryana State Agriculture Marketing Board and its own Judgment recently in AIIMS v. Ashok Kumar and a host of other judgments, the Hon'ble Court was pleased to overturn the Ld. Industrial Dispute Tribunal’s Order of automatic reinstatement with b/w to monetary compensation. 𝐑𝐞: 𝐍𝐨 𝐑𝐞𝐠𝐮𝐥𝐚𝐫𝐢𝐳𝐚𝐭𝐢𝐨𝐧 𝐨𝐟 𝐚𝐝-𝐡𝐨𝐜 𝐰𝐨𝐫𝐤𝐞𝐫 𝐦𝐞𝐫𝐞𝐥𝐲 𝐛𝐲 𝐭𝐢𝐦𝐞𝐥𝐢𝐧𝐞 𝐨𝐟 𝐬𝐞𝐫𝐯𝐢𝐜𝐞 On this second aspect, following the jurisprudence set by the landmark Constitution Bench Judgment in State of Karnataka v. Uma Devi, and BSNL v. Bhurmal, this Hon'ble Court fortified that a temporary worker cannot seek regularization and permanence in a Govt. department/public post merely by work-time line and when the initial engagement was not as per formal competitive procedure.
