What is SC/ST Act? A Brief Introduction Atrocities against members of the Scheduled Castes and Scheduled Tribes are not a thing of the past. They continue to be a reality in our society even today. Hence, the statutory provisions which have been enacted by Parliament as a measure of protecting the constitutional rights of persons belonging to the Scheduled Castes and Scheduled Tribes must be complied with and enforced conscientiously. Many perpetrators of caste-based atrocities get away scot-free due to shoddy investigations and the negligence of prosecution and this results in low conviction rates under the SC/ST Act giving rise to the erroneous perception that cases registered are false and that it is being misused. What is Patent? - Basics & Overview A patent is an exclusive right granted for an invention, which is a product or a process that provides, in general, a new way of doing something, or offers a new technical solution to a problem. The present Indian position in respect of patent law is governed by the provisions of the Patents Act, 1970. To get a patent, technical information about the invention must be disclosed to the public in a patent application. Patents can be applied for biological inventions such as designs, accessories, computer software, and cosmetic products, as well as commercial methods such as chemical formulas, compounds, processes, decorative items, nanochip technology, containers, and computer hardware. Patent Registration Office of India is headquartered in Kolkata and has branch offices in New Delhi, Mumbai, and Chennai. Understanding criminal State of Mind or “Mens Rea” The prime objective of the law is to punish the guilty mind by the provisions and procedures established by law. While deciding the liability of a person for the offence committed, it becomes important for fair and just adjudication, that no innocent is punished for an act which that person never intended to do. For this purpose, the framers of the law while drafting the penal statutes make it abundantly clear by defining who shall be held liable for committing a particular act or breach of law. Bigamy – Legal Provisions in India Bigamy is the act of marrying an individual while the legally wedded spouse is alive. The couples’ marital status as married is unaffected by their legal or de facto separation. A person who is divorcing his or her spouse will remain legally married until the divorce is complete or absolute under the laws of the relevant jurisdiction. In most of civilized nations, bigamy is illegal as only monogamous marriages are recognized and registered. The only exception is if Bigamy is permissible in religious and personal laws or established practice in the communities and cultures. Secularism in the Holy Book of Indians Religious diversity, without a doubt, necessitates the protection of all religions, sects, and religious practices within India. Under our Constitution, it cannot be presumed that the worship of one religion confers superior rights from another religion. It is true that a person’s relationship to what they consider divine is profoundly internal, and it exists within the boundaries of a private sphere into which no other individual is permitted to intrude. This is why the Constitution guarantees all citizens the right to profess, practice, and spread religion Read More: https://lnkd.in/gd92FsF6 #Secularism #ReligiousDiversity #ConstitutionalRights #ReligiousFreedom #IndianConstitution #EqualRights #LegalInsight #LegalAdvice #TheLawCodes #LegalAwareness

Arbitrability of IP Disputes Arbitration is one of the popular and structured forms of Alternative Dispute Resolution mechanisms in India. It is a way to avoid court proceedings and arrive at settlements, without any judicial proceedings. The disputes under arbitration are decided by an arbitrator who renders the ‘arbitral award’, which is legally binding on both parties. Arbitration has become a preferred mode of settling commercial disputes. The very nature of an arbitration settlement is fundamentally different from a judicial proceeding in many aspects. Apart from being a much faster and more convenient form of dispute settlement when it comes to enforcement Arbitral awards unlike court judgments are not directly enforceable. The party seeking enforcement might have to resort to judicial remedies. While this fore-mode settlement works perfectly for commercial and trade disputes come disputes cannot be trailed by arbitration. Therefore by their very nature, the subject matter of some disputes is not capable of being decided by arbitration. This is where the concept of “Arbitrability” comes in, what it means is whether the subject- matter of a dispute can be decided by an arbitral proceeding or not.
