"You Can Call Me AI" (with apologies to Paul Simon) As the use of AI ("artificial intelligence") marches on, judges and the courts are increasingly concerned over about the impact of AI and its use by testifying experts. Several key concerns and issues were raised at a session led by judges at the NACVA 2024 Business Valuation & Financial Litigation Conference held recently in Las Vegas: * What is the level of trust courts can place in AI-generated evidence? This relates to: - Reliability of AI outputs - especially the risk of "hallucinations" where AI generates false or fabricated information. (A while ago I tried to explore international flights using ChatGPT, and it recommended routes by listing flights that do not exist. The implications are worse in a court setting.) - Biases embedded in AI algorithms - without getting into too many details, it is pretty obvious results from AI are often skewed by the prompts used, or information provided. Such issues can obviously compromise fairness and accuracy, especially if the AI is treated as a black box, or an opaque oracle. * How does the court deal with the ethical and procedural issues posed by use of AI? Key concerns include: - To what extent should the use of AI must be disclosed in court? What constitutes a material AI disclosure requirement? - How should AI-generated materials be scrutinized or weighted as evidence? - How does one protect confidentiality, particularly when sensitive data find or can find their way into third-party AI platforms? - How does the court deal with the lack of any clear rules and standards regarding AI’s use? How can AI-based evidence be dealt with in a fair and consistent manner? The upshot at the Conference was that valuation experts, who often act as educators to the courts when explaining methodologies and processes, need to do the same with regard to AI. Another takeaway was that the valuation profession can work with judicial entities to establish best practices and guidelines for the ethical and responsible use of AI, including how to deal with thorny issues such as bias and data validation. Thankfully, we have Business Valuation Institute UK (BVIUK)'s Future Directions in Business Valuation Board and its AI Policy Council stepping up to help us navigate what will be a very challenging and interesting future.

AI and the vast field of business valuation ! What will be the impact of generative AI and machine learning on the profession of valuer ? The past two years have been an incredible journey for BVIUK. From a passionate idea to a thriving organisation, we’ve grown together in ways we couldn’t have imagined. Today, we’re excited to announce the next phase in our evolution: the launch of three visionary boards and the exceptional professionals who will guide them. Introducing Our New Boards and Members As we move forward, we’re introducing three boards designed to elevate BVIUK’s mission and expand its impact, each led by outstanding professionals appointed for the next two-year term: 1. Education Board Driving initiatives to enhance professional learning, this board will equip members with the knowledge and tools to excel. The Education Board will be led by Andrew Strickland, and joined by Graham Antrobus, BVIUK, ASA, CBV, CVA, ABV and Gary Trugman, who bring deep expertise and a shared passion for advancing education in business valuation. 2. Standards and Ethics Oversight Board Tasked with safeguarding integrity, this board will ensure that professional standards and ethical practices remain at the heart of our work. We welcome Drew Dorweiler 卓维 FRICS FCBV MBA CPA ABV ASA CVA CBA BVIUK CFE as the board’s leader, supported by Mark Zyla, David Haigh, David Young, and Fiona Hotston Moore Expert Business Valuer and Forensic Accountant, whose collective experience will uphold the values BVIUK stands for. 3. Future Directions in Business Valuation Board A first in our profession, this groundbreaking board will focus on tackling emerging and critical topics reshaping the business valuation landscape. Led by Graham Antrobus, BVIUK, ASA, CBV, CVA, ABV, and with members Ed Tahsin ACA BVIUK, Ben Macnaghten ACA MRICS, and Tanya Craft, ACA, BVIUK, the Future Directions Board will spearhead discussions on vital issues such as Artificial Intelligence (AI) and ESG. To support this work, we’re also proud to introduce two new Think Tanks under the Future Directions Board: 1. AI Policy Council: Led by Ascanio Salvidio, and exploring the transformative role of Artificial Intelligence, this council includes Drew Dorweiler 卓维 FRICS FCBV MBA CPA ABV ASA CVA CBA BVIUK CFE, Hafiz Imtiaz AHMAD Ph.D., CVA®, MAFF®, BCA, BVIUK,BCA-R, and Omar M. Zaman, MEng, MBA, who will guide its innovative efforts. 2. ESG Policy Council: Addressing environmental, social, and governance considerations and led by Graham Antrobus, BVIUK, ASA, CBV, CVA, ABV, this council is made up of Alexander Aronsohn FRICS, Nene Gianfala, CPA, ABV, ASA-BV-IA, William Thomsen, and Ahmad Zubir Zahid, who will lead our response to these critical challenges.
