The Environment and Land Court, in a ruling delivered on January 16, 2024, in Petition No. 44 of 2018 (Nancy Wanja Gatabaki & Another v. The Attorney General & 8 Others) has held that a chargee can apply to set aside a judgment that makes findings on the ownership of the charged property in instances where the chargee was not joined and/or heard before the judgment was delivered. The court recognised the interest of the chargee in the suit property and that a judgment delivered without hearing such a party has an error apparent on the face of the record. The ELC followed the Court of Appeal’s determination that a holder of a charge over property must be included as a party in any proceedings where the ownership of that property is at stake.
