  • The apex court of the land, Supreme Court of Kenya has on this 29th Day of October 2024 declared the Finance Act 2023 constitutional and valid, thereby setting aside the finding of the Court of Appeal. The Supreme Court however upheld the decision of the Court of Appeal as to the following provisions of the Finance Act: 1. The question of Affordable Housing Levy introduced by the Finance Act 2023 which was declared moot by the Court of Appeal owing to the introduction of the Affordable Housing Levy Act. 2. Sections of the Finance Act amending the Kenya Roads Act and the Unclaimed Financial Assets Act, which were declared unconstitutional by the Court of Appeal as these provisions were not incidental or directly connected to the money bill (Finance Act). To this extent, status quo remains the same and the Finance Act 2023 is in force and operational as enacted.

    If you were issued with a new title deed last week or recently, you must have had a long weekend after the shocking notice from the Government Printer on the theft and cancellation of title deeds. What is the role of the Government printer? The Government printer is under the Government Press, a department under the Executive Office of the President as per the Executive Order No. 1 of 2023. It is responsible for printing and publishing official Government documents like laws of Kenya, the Kenya Gazette etc. What is a title deed? A title deed, also known as a certificate of Title or Lease, is a legal document that proves ownership and legal rights over a piece of land or property. Section 30 (3) of the Land Registration Act (2012), defines a certificate of Title or Lease as prima facie evidence of the matters shown on the title shall be subject to all entries in the land registrar. Who has the power to cancel a title deed? A court of competent jurisdiction in Kenya has the authority to revoke a title deed in instances of fraud or illegal transfer or entries made on the land register. Section 33(4) of the Land Registration Act (2012) also grants the Land registrar the power to cancel a certificate of title or certificate of lease in case where one was lost and found. The National Land Commission as provided by section 14 (5) of the National Land Commission Act The Government printer doesn’t have the power under any laws of Kenya to revoke or cancel a title deed.
