TAX ALERT: PROOF OF OPERATIONAL EXPENDITURE LIES IN PROVIDING PRIMARY DOCUMENTATION The case involves a company based in Meru County that deals in telecommunication supplies. The additional income tax assessments covered the years 2015 to 2017. The KRA conducted tax investigations into the Taxpayer’s business and issued the additional assessments on 18th March 2020. The Taxpayer objected to these assessments on 21st July 2022, citing various discrepancies and errors in the KRA's calculations. The Taxpayer’s primary contentions were that the KRA partially allowed cost of sales and expenses, resulting in an incorrect additional tax assessment. Specifically, the Taxpayer argued that the KRA improperly adjusted purchase figures based on VAT returns, neglecting some invoices that did not meet VAT statutory requirements. The Taxpayer also claimed that operational, administrative, and establishment expenses were entirely disregarded by the KRA. Additionally, the Taxpayer highlighted the sickness of a key director as a factor that delayed the review process and the provision of necessary documents. In response, the KRA maintained that the additional assessments were justified, based on discrepancies between sales declared in VAT returns and those in income tax returns for the same periods. The KRA further stated that the Taxpayer failed to provide necessary supporting documents despite requests during the objection process. The KRA cited sections of the Tax Procedures Act (TPA) that empower it to assess tax liabilities based on available information and its best judgment, arguing that the Taxpayer’s objections were submitted late and lacked adequate documentation. The Tribunal’s analysis focused on whether the Taxpayer provided sufficient documentary evidence to support its appeal. “…According to the Tribunal, the Taxpayer did not file the necessary documents to substantiate its claims or prove the incorrectness of the KRA’s decision. The Tribunal emphasized that the burden of proof lies with the taxpayer to demonstrate that an assessment is excessive or incorrect, as stipulated by the Tax Procedures Act and the Tax Appeals Tribunal Act…” Ultimately, the Tribunal found that the Taxpayer failed to meet its burden of proof and dismissed the appeal. The Tribunal upheld the KRA’s objection decision and additional tax assessments dated 19th September 2022, ordering each party to bear its own costs.
