On 25 October 2024, the European Commission published the Delegated Regulation supplementing Regulation (EU) 2015/760 of the European Parliament and of the Council on ELTIF RTS. This covers hedging derivatives, redemption policies, transfer requests, asset disposal criteria, and cost disclosures. The ALFI Seminar on Taxes for Investment Funds took place yesterday at the Luxembourg Chamber of Commerce. Vilma Domenicucci, ALFI’s Head of Tax, opened the event with a warm welcome. Patrice Fritsch (EY) moderated the first panel, which focused on operational taxation, with insights from Judith Mertesdorf (Franklin Templeton International Services), CAMILLE PEREZ (PwC Luxembourg), and Uschi Tiemann (JPMORGAN ASSET MANAGEMENT (EUROPE) SARL). Olivier Schneider (KPMG Luxembourg Tax and Advisory) then delivered a compelling keynote on the refund of withholding tax under Art. 63 TFEU, highlighting a recent German case. He was later joined by Vilma Domenicucci and Frederic BATARDY (Ministère des Finances) for a discussion on #FASTER. Following a coffee break, Philippe Ghekiere (PwC Luxembourg), Enrico Campestrin (Swiss Life Asset Managers), and Pierre-Antoine Klethi (Loyens & Loeff Luxembourg) explored global minimum taxation, focusing on the OECD’s Pillar Two Model Rules and their implications for investment fund structures under the related EU Directive. The final session featured an engaging interview with jean-paul olinger, Director of Administration des contributions directes, led by Keith O'Donnell (ATOZ Tax Advisers Luxembourg). According to the ALFI/KPMG Luxembourg Private Debt Fund Survey 2024, despite global market challenges, AuM increased by 21% to €510 billion from June 2023 to December 2023.
