As the EU adopts new AML/CFT regulations, it's clear we're moving towards an even more harmonized compliance framework. Article 11 of AMLR raises an important question for Luxembourg: will the collective RR model remain viable? The wording seems to imply a shift towards a single designated person for both RC and RR roles. Or, does the management body’s collective responsibility allow the collective RR to continue, with a delegated RR added? Your insights on this would be valuable. 🔍 Non-Profit Organizations: Enhanced Vigilance Against Money Laundering 📅 On May 30, 2024, the CSSF issued a critical communiqué regarding non-profit organizations and the fight against terrorism financing. ❓ The crucial question is: how many NPO directors, who are often not involved in financial services, have actually seen this communiqué? Here are the key points: 1/ Risk Assessments: Risk assessments published by the Ministry of Justice in 2022 indicate a high risk of terrorism financing for certain NPOs. 2/ 2/ Vulnerabilities: Donations received and the destination of funds should be closely watched. 3/ Increased Pressure: Banks are now required to closely monitor NPO activities and document the roles and responsibilities of governing bodies. In cases of doubt, they might even terminate their services. It is imperative for NPO directors to be aware of these risks and take proactive measures. Governance must extend beyond traditional obligations to include robust controls against money laundering and terrorism financing.
