About us
aditus foundation was established in 2011 by three lawyers dedicated to ensuring human rights access in Malta. The Latin word for ‘access’, aditus' mission is the analysis of access to human rights recognition and enjoyment. aditus was established to monitor, report and act on human rights access for individuals and groups. aditus was founded on the principles of the universality, interdependence and indivisibility of all human rights. We adopt a broad perspective for human rights, identifying themes such as discrimination and access to effective remedies. While focused on Malta, we highlight the regional and international implications of local obstacles to human rights access. Our main activities include the identification of priority areas, formulating advocacy strategies and working towards improvement in legal and administrative standards. This includes offering pro bono legal information and advice. We remain in constant communication and cooperation with governmental, intergovernmental and non-governmental entities to maintain a comprehensive approach. aditus is committed to engaging the public in human rights discourse that is well informed and unbiased , through press statements and TV and radio appearances. We also make full use of the Internet to disseminate information, raise public awareness, gather advocacy support and establish contact with individuals and networks. aditus is Secretariat for the Platform of Human Rights Organisations in Malta. It is registered with the Malta Commissioner for Voluntary Organisations, and has affiliations with the International Detention Coalition, the Platform for International Cooperation on Undocumented Migrants, the European Council on Refugees and Exiles, the European Network on Statelessness and the Anna Lindh Foundation. We are also members of the Consultative Forum of the European Asylum Support Office, and of the Fundamental Rights Platform of the European Union Agency for Fundamental Rights.

📚 The #AIDA Country Report on #Malta is OUT ➡️In 2023, Malta received 600 asylum applications, with 833 cases pending at end of the year. ➡️The overall protection rate at first instance was 27.9%. ➡️Despite a 2022 European Court of Human Rights judgment which criticised Malta’s accelerated asylum procedure, it remained unchanged in 2023. Legal practitioners continued to argue that it violated the obligation to provide an effective remedy for all negative decisions. ➡️A new policy also barred people who filed subsequent applications which were deemed inadmissible from accessing employment. This measure was criticised by NGOs who argued that it discouraged asylum seekers from filing subsequent claims and, thus, limited their access to legal remedies. ➡️Access to detention centres and detained asylum seekers remained a significant challenge throughout the year. ➡️In 2023, Malta’s Human Rights Directorate launched a national consultation on the country’s second National Integration Policy and Action Plan. A public consultation document was published which included key principles for the upcoming strategy and questions to guide public input. During the MALTA - OSCE24 Warsaw Human Dimension Conference, our team members attended interesting side events including one that focsued on climate change and refugees, and one on the critical need for monitoring places of detention to prevent torture, emphasizing that, in both peace and conflict, access to detention facilities by independent monitoring bodies is essential to safeguard the rights of detainees.

Marine Giorgis, Michela Farrugia and Kirsten Gatt registered and all set for an exciting week at the OSCE. They will spend the week particpating in sessions covering various topics including humanitarian crises, refugees, trafficking, and the rule of law. The conference is being organised by the 2024 OSCE Chairpersonship of Malta, together with the OSCE Office for Democratic Institutions and Human Rights (ODIHR). Their travel was possible thanks to the support of the Ministry for Foreign and European Affairs and Trade.

We are representing an asylum seeker who had arrived in Malta as child. This case is part of our ongoing campaign challenging Malta’s detention regime, especially when it violates the rights of children and other vulnerable persons. The Court will give its judgement on 5 December 2024 (watch this space). Despite repeatedly stating his age upon arrival, our client was wrongfully placed in an adult detention centre for around 2 months. Throughout this time, he was treated as an adult. The conditions he faced during his detention were degrading and inhuman, leaving him with lasting trauma which he continues to struggle with today.
