While #negotiable #eBL and #ePresentation volumes in bulk flows have risen steadily in recent years, eBLs for containerised transport remain limited. A key to unlocking volumes in liner flows is interoperability: i.e. enabling an eBL issued in one eBL solution to be securely transferred to another eBL solution, while retaining its (legal) characteristics as a bill of lading. Together with IQAX, we have been working on addressing the 4 critical components of interoperability: - a technical solution to ensure one original eBL is in existence, and controlled by the rightful holder, at all times: the Digital Container Shipping Association (DCSA) standards have provided critical inputs for this aspect - a legal solution to ensure that the eBL is the legal equivalent of a paper BL: this is achieved by ensuring that the eBL is (expressly) governed by an eBL enabling law such as the #UK’s #Electronic Trade Documents Act 2023 or #Singapore’s Electronic Transactions (Amendment) Act 2021 - a liability regime governing the rights and obligations of each of the solution providers, ensuring the right party is responsible for losses and that they are able to pay - approval by the International Group of P&I Clubs to ensure that carriers issuing interoperable eBLs are insured by their Clubs The final piece of the puzzle fell into place today: the ICE Access Agreement 2024.1 was approved by the #IG, confirming that #ICE #CargoDocs eBLs can be transferred to users on other platforms. The ING-led syndicate for the $2.8bn borrowing base facility for Trafigura’s concentrates business involves 27 banks, and is the first deal to recognize electronic bills of lading (#eBLs) as fully #secured #collateral documents in the syndicated loan market. Incorporating #ICE #CargoDocs eBLs as secured collateral was enabled by the #UK’s Electronic Trade Documents Act (#ETDA), which provided the legal framework for their enforceability.
