Today, the Supreme Court of Mauritius has delivered its judgment in the case of Coca-Cola Indian Ocean Islands Ltd v the Assessment Review Committee (ARC) & the Director General of the Mauritius Revenue Authority [2024 SCJ 422], ruling in favour of the Appellant. Johanne Hague and Bilshan Nursimulu acted for the taxpayer, instructed by Rajesh Bucktowonsing, SA in this matter. The case arose from an ARC decision to dismiss the Appellant's representations on the grounds of vagueness. The ARC cited the Appellant’s use of "See Attached" in the space for "Precise Reasons for Representations" on the standard form and criticised the accompanying "Reasons for Representation" document as unclear and ambiguous, stating it needed to be read in conjunction with the notice of determination. In its judgment, the Supreme Court ruled that the ARC’s decision was unjustified. The Court found that the Appellant had filed a Statement of Case sufficiently clear for the Mauritius Revenue Authority (MRA) to submit a Statement in Reply. Furthermore, the Court noted that the key issues were easily identifiable from the Appellant's representations and did not warrant the ARC’s refusal to hear the case. Judges Chan Kan Cheong and Beekarry-Sunnassee also pointed out that the ARC’s 2019 ruling in Eurofin Ltd v Director General, Mauritius Revenue Authority [ARC/IT/572-24] provided a more appropriate approach by allowing any perceived vagueness in representations to be remedied. The Court emphasised that denying taxpayers their right to a hearing before the ARC is an "extreme measure," as highlighted in Varcity Mauritius Ltd v The Assessment Review Committee & Anor [2024 SCJ 260], and should not be applied lightly. We remain hopeful that the ARC will take the Supreme Court's observations into account and adopt a more balanced and consistent approach in its future rulings, recognising the importance of taxpayers' right of access to the Courts.
