✅ Lets talk about references in Employment and the position of the Law in Nigeria ✅ as well as the Dangers 😂 ❌ ❌ It is no longer news that a lot of companies do not like giving references to their former staff when they exit the company. Most times, it is due to how such employment contract ended. which is why a lot of HR Professionals and Line Managers etc, always advice employees not to burn bridges when leaving their place of work and to follow the right process and procedures. Generally in law, there is no legal obligation on an employer to provide a reference when required to do so by a new employer on behalf of a former employee. However, in a situation where an employer decides to give the said reference, they must ensure that such reference are true and represent the correct opinion I/R of the former employee. This is because an employer who does otherwise and provides an incorrect referral can be sued for the tort of defamation(Libel) by the former employee. In addition, the new employer can equally institute a legal action against the former employer who issued such misleading or defamatory statement on grounds of deceit, if it was done either deliberately or for negligent misrepresentation, if made in a careless and reckless manner. which is why Line managers, HR etc. who are fond of giving references without the company's knowledge needs to be careful. we understand that you want to play sister righteousness and brother holiness 😅 😅 but please be careful when doing so and if possible carry the company along or follow the due process. Let's take a clue from the decided cases below 👇 📌 In the case of Coote V Granada Hospitality, An employee who had earlier instituted and won a case of sexual discrimination against her employer now decided to leave the company for another one. she actually got another job and her confirmation is subject to a satisfactory reference from her previous employer 😂 And like you have guessed the employer refused to provide the referral. 😅 the court held that failure on the part of the employer to provide the reference was discriminatory because evidence was led to the fact that the employer has provided a reference to other employees in the past who have worked with them previously. 📌 In Dike V Ziegler Rickman while providing a reference in respect of a former staff, an employer indicated that mr dike is a very difficult man to work with and we shall not sorry to loose his services 😅 Dike sued his previous employer but lost the case because it was established that he was a very difficult person to work with. 😂 In conclusion, in practice, employers usually provide reference when required to do so by a new employer on behalf of a former staff in fulfilment of a moral and social duty owed to the society at large. ❌ ❌ Stop cheating employees at Exit ❌ ❌ There was this time my younger sister was laid off and she called me that faithful day to tell me what was happening. At the time i was at work. So to cut the long story short after listening to her i told her what to do. Just like every other person she was sad and didn't know what the future holds for her. I told her the future will take care of itself 😁 but for now lets claim her entitlement. In this case she was entitled to Prorated leave days, in lieu of notice payment as well as the days worked in for the month of termination. Trust me it was a long drama before all these were paid. Knowing the kind of employer she was working with at the time i told her not to leave the premises until she gets full payment of every single entitlement to her. Because of her the others who didn't know about this were also paid. This opened the eyes of so many employees there because before her nothing of such had be done before. so my question is, if she had not had me as her older sister what would have happened. And there was an HR in that company. So here is the thing, bonuses and Profit sharing, leave allowance, 13th month etc are discretionary as well as how the employer decides to run his/her business. However when any of these benefits becomes part of an employee Gross Pay, it automatically becomes an entitlement. And should be calculated on prorated basis and paid to the employee at exit. So stop cheating these guys at exit just pay 🤷♀️ ❗
